In Norman, Oklahoma, a toddler was recently attacked by a wild cat at a zoo. The 3 year old boy did suffered personal injuries in the form of wounds on his head. Fortunately, the injuries were not serious or life threatening according to the Fox News article. The wild cat, a European Lynx, weighed 45 pounds and approached the child through a chain linked fence. This incident certainly cannot be faulted to the animal who is living in a man made environment.

It was reported that the boy left the visitor path of the zoo and then went through a roped off barrier and then over a railroad tie wall that was low in height and then up to the Lynx at the chain linked fence. After the incident, a solid fence was built to keep the public away from this area. This will, in turn, prevent wandering children like this toddler from unknowingly getting into a dangerous area.

Parents should take note of this incident and do their best to keep a watchful eye on children at zoos and any other areas where animals are present.

State of Ohio - New Booster Seat Law Going into Effect for Children Ages 4 through 7

By Will Brown, Attorney and David Wolf, Attorney
Published by Child Injury Lawyer Network

US%20State%20Flag%20Ohio.jpg

The State of Ohio has joined the majority of States by enacting a child booster seat law. The law will go into effect in October 2009. The Ohio law requires that children between the ages of 4 through 7 with specified height and weight requirements be placed in a booster seat. The law requires all Ohio residents and all those visiting the State of Ohio to comply with this law. Due to the size and body characteristics of children this age, adult seat belts often times are not effective in preventing injuries. Furthermore, in many instances, an adult seat belt without the presence of a child booster seat can cause serious injuries to a child. You can read more about the Ohio law and comments regarding the same at State of Ohio to Require Car Booster Seats for Children.

A video camera was found in Fulkerson's bathroom. At this time, the Professor is on leave pending the disposition of these allegations.

It is quite disturbing that people in positions of trust like professors, teachers, health care providers, and others have a sick and twisted perversion that would prompt them to commit these horrendous and immoral crimes. In Prince George County, Maryland, firefighters responded to a fire at an apartment complex. It was reported at the Firefighting News website that the fire was brought under control in 7 minutes. Children from a day care center were evacuated for safety reasons and the risks of injuries from fire / smoke inhalation / and / or danger from the damaged building. No injuries were reported.

This incident shows the importance of having evacuation plans in place when there is an unexpected emergency or incident like a fire. While fires in or near day care center will not happen at every day care center, these incidents cannot be predicted. It is far better to be prepared for an event like a fire rather than rely on probabilities and statistics. When a child's safety is at risk, planning and procedure are of paramount importance.

Roman Polanski Case - Question: Should He Be Extradicted from Switzerland for Child Sex / Child Rape Charges? Answer: Absolutely

By David Wolf, Attorney
Published by Child Injury Lawyer Network

Country%20Flag%20Switzerland.jpg

Roman Polanski is a famous and talented director who has been honored with awards. He is also a man who has been on the run from the law / authorities in California for over 30 years. Rather than serve a prison term that he faced for crimes committed in California, Roman Polanski fled to Europe. On a recent visit to a Switzerland film festival, Mr. Polanski was arrested and now faces extradition to the United States. Through the years, Mr. Polanski has benefited from his fame and skills as a movie director. These attributes are not defenses to the crime committed. Like anyone else, Mr. Polanski should be extradicted to the United States to face the punishment and criminal sentence for crimes that he has admitted to. Mr Polanski pled guilty to having sexual intercourse with a 13 year old girl. Many child advocates would refer to these acts as child rape rather than sexual intercourse. Whatever terminology is used - a crime is a crime and Mr. Polanski should be punished for these crimes. Of course, Mr. Polanski will be entitled to an attorney to represent him in this matter. Grand Praire, Texas Day Care Van Rolls Over - 23 Children Suffer Personal Injuries

street%20light%20red%20traffic%20light%20white%20background.jpg

In Grand Prairie, Texas, twenty three children were injured in recent day care van accident. A story posted at The Dallas Morning News reported that the automobile / van accident took place near the Grand Prairie Municipal Airport. The driver and all of the child passengers were transported to local hospitals for treatment. There were no serious personal injuries reported; however, it will take some time and further evaluation to really determine the severity of the injuries to these children. Witnesses stated that that the van entered the intersection during a red light, collided with a SUV, and then rolled over.

Day care van drivers have a duty to exercise due caution when transporting children. Obviously, all traffic signals including red lights and stop signs should be followed. Furthermore, close attention should be used as to traffic and all other road conditions. It is also vital that day care center drivers avoid driver distraction like mobile phone use, texting, e mailing, eating, and reading. Safer driving and the avoidance of driver distraction can help reduce the number of automobile accidents involving children being transported by schools and day care centers in Texas and other States.

Las Vegas, Nevada Day Care Center - Investigation and Arrest - Sexual Assaults and Abuse of Children

By David Wolf, Attorney
Published by Child Injury Lawyer Network

Education%20Day%20Care%20Building%20Block%20F.jpg

In Las Vegas, Nevada, police are investigating a day care center that was in operation from 2001 through 2009 called Holly Andrews' Day Care. This day care center was based in a home and was licensed to care for up to six children. A story published in the Las Vegas Review Journal reported that the owner's son (Matthew Joseph Andrews) was arrested and charged for sexual assault of a child. The arrest did not involve a victim from the day care center; however, since the arrest, two families have come forward with children with allegations that they were sexually assaulted for molested by Matthew Joseph Andrews when being cared for at this in home day care center.

These other incidents / allegations took place when Matthew Joseph Andrews was between the ages of 11 and 13. The police investigations will be challenging due to the passage of time and the probable lack of physical evidence to support the proof of such crimes.

This story shows some of the dangers of certain day care centers. Criminal background checks do help weed out dangerous or potentially dangerous day care workers / child care workers; however, if there is no criminal past or record, then day care workers / child care workers are often hired despite their propensities to harm children. In this case, it was a child on child crime which is very difficult to predict in many cases. Unfortunately, children were victimized in the very place (a day care center) where they were expected to receive quality care and supervision as to their health, safety and welfare.

Columbia South Carolina Day Care Operator Sentenced to 20 Year Prison Term for Child's Death

US%20State%20Flag%20South%20Carolina.jpg

In Columbia, South Carolina, a day care operator was recently sentenced to 20 years for the death of a child under his care. Willie Ritter, age 65, who served in the Army as a Lieutenant Colonel, pleaded guilty to the crime. Mr. Ritter left a 9 month old child in a closed hot van. The child died from complications due to hyperthermia. Javon Simpson was not given the chance or opportunity to do so many things that a child or person should be able to do during a lifetime. His death was tragic and preventable.

Mr. Simpson's crime of neglect involved not only leaving the child in the van but also failing to obtain timely medical care. While Mr. Simpson admitted to the crime during the criminal proceedings, it was reported that he initially attempted to mislead investigators regarding the facts and circumstances related to the child's death.

You can read more about this article at Columbia South Carolina Day Care Operator Sentenced to 20 Years for Child's Death.

Unfortunately, there are many victims like Javon Walker who have died or who have suffered serious personal injuries due to the neglect of day care center operators and child care providers. Every day care center that transports children should have a clear, defined and written policy and procedure for supervision so that these tragic incidents never happen.

Cumberland County, Maine Grand Jury Indicts Day Care Owner (Ronald Meserve) for Possession of Sexually Explicit Materals

Published by Child Injury Lawyer Network

US%20State%20Flag%20Maine.jpg

In Maine and other States, working parents trust that the owners and staff of day care centers are trustworthy people who will protect their children during the working day. While most day care owners and employees are trustworthy, others are not. Some day care owners have been arrested for abuse and neglect. Some have even been arrested for the possession of child pornography. It is quite disturbing that a day care owner would possess such obscene materials. It makes one question what activities went on at the day care center itself. In Cumberland County, Maine, a grand jury recently returned an indictment against a day care owner on charges of possession of child pornography. Ronald Meserve, age 53, was indicated on four counts of possession of sexually explicit materials. Mr. Meserve was arrested in the Spring of 2009. Mr. Meserve co-owns Teddy Bear Day Care Center with his wife.

If Mr. Meserve had never been arrested or charged with such crimes before, it would be difficult if not impossible for parent to predict or know that such a person was operating the day care center. Mr. Meserve has a right to defend himself on this matter. There may be defenses that the material was not his or he had no knowledge of such materials on his computer. Computer forensic experts will probably be involved in such a case. These experts should be able to determine the origin of these materials, when they were downloaded and viewed, and what accounts were used to obtain such materials. In New York, high school students from Lewiston Porter High School were suspended for being involved in a hazing incident involving raw meat. The incident involved players from the soccer team who threw raw meat and other food items at new players on the team. The ritual also involved putting eggs and flour on the new players. The suspension were for a few days.

Some may argue that this food incident was "harmless fun". Others will point out that it is a form of "hazing" since it involved demeaning acts. Any incident that involves the humiliation of a student should be banned and these acts should be punished. Furthermore, hazing incidents often times do lead to serious personal injuries and deaths. What if one of the new soccer players suffered an eye injury from the shell of an egg or by the flying meat? The bad acts should not be excused just because there were no physical injuries.

Children should be able to participate in high school sports without humiliation or hazing. Making the team should be based on school policy and procedure only rather than the additional requirement of student hazing. In Utah and other States, homeowners take on home construction projects every day. Some homeowners are very handy and able to perform the work necessary to repair homes and even add additions to the home. It is important to know how to do the work and also follow strict safety precautions when performing the work. In Murray, Utah, a roof under construction collapsed on the homeowner and a child according to local firefighters. It was reported that the trusses were set up without proper bracing. Numerous sheets of plywood were stacked on the roof. The weight shifted on the roof which, in turn, led to the collapse of the roof on top of 6 people who were eating lunch underneath. Medical care was required for a man and a boy. While there were no critical injuries reported, this incident could have lead to serious injuries and even deaths to those in or near the home. Safety precautions are vital when performing home improvement projects. In many cases, it makes more sense from a safety standpoint to hire a certified contractor to oversee the work so that incidents like this roof collapse do not happen. Special Needs Children Are At Risk for Injury from Being Pushed or Locked in Closets in Schools - Lawsuit Filed in West Hartford, Connecticut

educations%20school%20day%20care%20alphabet%20on%20black%20chalkboard.jpg

The Hartford Courant Newspaper website reported that the West Hartford, Connecticut Board of Education was recently sued by the mother of a child who was injured in the school system. The lawsuit alleges that a school employee (special needs paraprofessional) caused injury to a special needs / special education child when she slammed a door on his toe as she was putting him into a closet for disciplinary purposes. The boy's foot was partially in the doorway at the time. As a result thereof, the boy suffered a serious personal injury to his toe.

In many schools throughout the nation, it has been reported that teachers, paraprofessionals, aides, and / or school officials / administrators have used closets and small spaces for disciplinary purposes. This type of punishment is akin to imprisoning the child rather than serving as any constructive disciplinary measure. In many instances, the thought of being locked or pushed into a closet even further aggravates the special needs student. Whether the issue is attention deficit disorder, hyperactivity, behavioral problems, autism, or learning disability, locking up a child in a small and dark area typically is not the best way to discipline the child. Closets should be used to store boxes, school supplies, and brooms . . . Closets should not be used to lock children up in our school systems.

No details were reported as to the cause or mechanism of injury. As part of the criminal investigation and / or civil investigation by a Child Injury Lawyer, it would be important to know the following:

What injuries were caused to the child?

Were there any witnesses to the incident or incidents?

Did Ashley Beck make any statements regarding the incident?

Did the day care facility have video equipment or photographic equipment that documented the incidents or injuries?

How long had Ashley Beck been employed at A Learn & Play Academy?

What training and experience did Ashley Beck have in working with children?

Parents in Georgia and other States rely on day care centers and child care workers to provide for the health, safety and well being of their children. It is unfortunate and tragic in many instances that children are injured by the negligent and intentional acts of those charged with the responsibility of supervising and caring for children.

In Illinois and other States, it is vital that day care owners provide for the safety and well being of the children. Day care centers have a duty to remove hazards from the facility. In Chicago, a day care center was recently shut down. Police officials determined that the day care center was a site for dog fighting. Obviously, the day care operators or employees put profit and sport over any concerns for the safety of the children in the day care center. It is truly amazing and frightening that people would conduct a dog fighting ring / operation in the same location as a day care center. Investigators, who raided the location of the day care center, found battered, injured, and malnourished dogs as well as blood stains on the carpet right near where children were being cared for. Average Costs of Alabama Day Care - Factors to Consider in Selecting a Day Care Center

By Scott Soutullo, Attorney and David Wolf, Attorney
Published by Child Injury Lawyer Network

education%20school%20day%20care%20cup%20of%20crayons.jpg

In Alabama, parents must considering various factors in selecting a day care center. These factors include: costs, location, staffing, size, programs, credentials of staff, licensing, insurance, history of the facility, and hours of operation. The the Press Register recently reported that the average cost of full time day care for infants in the State was $5,460. Parents, of course, should consider much more than the cost of the day care when selecting a facility. Prior to enrolling a child in a day care facility, a parent should inspect the facility, interview staff members, speak to other parents, review the licensing information and prior inspections, and contact the Alabama Department of Human Resources. It was reported that the Alabama Department of Human Resources licenses approximately half of the state's day care centers.

Many parents find out about problems at a facility only after a child has suffered personal injuries and tragically in some cases death. Hopefully, a careful screening by a parent will avoid placement in a facility that lacks the supervision and safety measures that are necessary and vital for the health and welfare of Alabama's young children.

Strollers - Common Mechanism or Cause of Injury - Safety Tips

By David Wolf, Attorney
Published by Child Injury Lawyer Network

baby%20stroller%20yellow%20safety.jpg

A study reported in the Pediatric Emergency Care Journal has reported that strollers are a common mechanism or cause of injury to children. Many injuries to children during stroller use or stroller occupation can be avoided by some basic safety measures and supervision including the following:

*Safety Belts or Seat Belts. Most strollers are equipped with a safety belt or harness. No matter how short or long the trip- use this most important safety device at all times.

*Stroller Brakes. By consistently using or applying brakes when stopped, many injuries can be avoided. The application of the brake will reduce or prevent incidents in which strollers roll or crash into objects when left unattended.

*Lock Stroller Parts into Place. Many strollers collapse or convert into more compact objects. Like an umbrella, make sure that each part snaps into place. By paying close attention to this safety measure, parents can avoid or prevent incidents when strollers unexpectedly collapse during use. This, in turn, prevent the incidents of personal injuries to children.

*Do Not Attach Bags or Backpacks to Strollers. Many strollers tip from having heavy bags or backpacks attached to the handle part of the strollers.

California State Regulators Seek to Revoke License of Anaheim (YMCA) Day Care Center

US%20State%20Flag%20California.jpg

California regulators file a complaint against the YMCA Children's Station after two toddlers wandered off during an outing and were found on nearby railroad tracks. The day care center took these children and other children enrolled in the day care program to a local park. The two children wandered away but were found by others. Fortunately, the children did not suffer any serious personal injuries. The children were unsupervised and could have been abducted. The fact that the child were not seriously harmed or abducted does not and should distract from the danger that they were put in by the failed supervision. Further investigation by the Department of Social Services revealed that the day care center did not have the proper staff in place and were also deficient in its polices and procedures for signing in and out of the children.

The Department of Social Services is the California governmental agency that licenses, inspects, and otherwise regulations day care centers / child care centers. The Department noted in the complaint filed against the day care center that the facility also failed to timely notify parents of the incident. New York legislators passed New York safety restraint / seat belt laws for the safety and protection of all occupants in a vehicle including the smallest and most vulnerable occupants of vehicles - children. The New York State Department of Motor Vehicles has a good summary of the New York Occupant Restraint Laws posted to its Official Website at New York State's Occupant Restraint Laws.

New York law requires the following:

*Driver and every front seat passenger must wear a seat belt;

*Every occupant of a vehicle driven by a holder of a learner's permit and other restricted driver's licenses must wear a seat belt; and

*Every passenger under the age of 16 years old must wear a child safety restraint that is in compliance with the child's height and weight.

Licensed and Unlicensed Day Care Centers in Alabama - How Often Are Facilities Inspected?

By Scott Soutullo, Attorney and David Wolf, Attorney
Published by Child Injury Lawyer Network

Education%20Day%20Care%20Building%20Block%20G.jpg

The Mobile County Health Department is the only health department in Alabama that has undertaken the task of monitoring and inspecting day care centers. The Alabama Department of Human Resources is the state agency that is responsible for day care licenses, inspection, and the over all regulation of these facilities. The current structure of Alabama law and regulation allows day care centers affiliated with a church or faith based group to operate without a license from the Department of Human Resources. The day care centers that are licensed undergo an inspection every 2 years according to current regulations. Unfortunately, many day care centers that violate the regulations or have an unsafe environment in place go undetected. This, in turn, puts children at risk.

The work and efforts of the Mobile County Health Department help fill the gap or hole created by the license and regulation system in place for day care centers. It is important that day care centers follow the regulations. Those facilities that are not licensed should responsibly provide for a safe environment for the children. In addition, consistent supervision of the children can help avoid serious personal injuries / deaths in the day care setting. You can read more about the Mobile County Health Department and the issue of licensed / unlicensed day care centers at Alabama Day Care Centers - Licensed / Unlicensed Facilities.

With the start of a new school year, traffic increases for everybody. Parents must rearrange their schedules to meet the demands of their children's educational needs. In addition, parents must deal with another issue that seems to come up every school year - bullying. Allan L. Beane is the author of "Protect Your Child from Bullying". Mr. Beane offers the following advice to parents:

*Tell your children to let you know if they are being bullied;

*Tell your children that you want to know about bullying incidents;

*Tell your children that no one deserves to be the victim of a bully; and

*Tell your child that you will try to work with them to try to deal with the situation in a way that does not make things worse.

While parents cannot fix every problem for a child, it is important for a parent to be involved and to let the child know that they have a support system in place for helping them deal with the real issue and problem of bullying.

New Jersey Bill Seeks to Make Furniture and Homes Safer from Falling Furniture and Televisions

State%20Map%20New%20Jersey.jpg

In New Jersey and other States, children are put in danger every day from unanchored televisions and heavy furniture that are prone to tipping over. Every year, children sustain serious personal injuries and even death when a television or piece of furniture like a bookshelf or bookcase tips over onto a small child. These dangers have prompted New Jersey lawmakers to propose a bill that would require manufacturers to include documentation / information with the sale of televisions and furniture. The documentation / information would include safety tips and products that can be purchased to anchor down or secure the television or furniture item. Under this proposed law, consumers would be provided with the information when they buy or rent the item. The bill is called "Chloe and Samatha's Law". Chloe and Samantha are two of many children who were killed when a television tipped over on them in separate incidents. The National Highway Traffic Safety Administration (NHTSA) Recommends that South Dakota, Arizona and Florida Enact Booster Seat Laws for Children

The National Highway Traffic Safety Administration (NHTSA) is recommending that three states (South Dakota, Florida, and Alabama) enact or pass legislation to require booster seats for children through the age of seven. According to the NHTSA, the 47 other states have enacted such child booster seat legislation. The push to pass legislation comes at the same time period as National Child Passenger Safety Week which runs from September 12 through September 18. The South Dakota legislature previously passed a law that was ultimately vetoed by the governor in 2007. Child safety advocates argue that booster seats lower or decrease the risk of injury to children who are involved in automobile accidents. The NHTSA takes the position that the legislation should apply to children through the age of seven. Passing legislation that sets the upper age limit at an age younger than seven puts children at risks according to some safety experts.

A New Zealand woman (Itupa Julie Mikaio - age 40) has been charged and is being tried for causing serious personal injuries including head injuries to her three year old son. Prosecutors state that this mother beat her child because he wet his bed. Whether child abuse results in serious personal injuries requiring surgery like this case or just minor or no physical injuries, physical force should not be used as punishment or discipline. This is especially true due to the risk of serious personal injuries. There is also a psychological component to beating a child or threatening physical harm to a child. As evident by this story, child abuse and neglect is a worldwide program that still takes place every day to the detriment and harm of children. In Boise, Idaho, children were removed by the Sheriff's office after a search warrant revealed dirty / squalid conditions at the home. The parents (Stacey Marie Cox and Michael Cox) were living in the home with four children ranging from the age of 3 to the age of 8. Adults generally have the right to live as they please as long as the health, safety, and welfare of others including children are not affected. In this home, detectives found what was reported as "deplorable" conditions.

While economics and employment may play a role in the presentation and cleanliness of a home, being poor is not excuse for caring for children in this environment. Throw away the garbage, remove spoiled food, and focus your attention on your children.

A spokesperson for the Ada County Sheriff's Department reported that the children, in addition to living in these horrible conditions, also were the victims of physical and sexual abuse. You can read more about this story at Parents Arrested in Boise, Idaho - Home Deplorable - Children Removed.

Ohio Day Care Workers Paid Under Minimum Wage (Dangers of Underpaying Child Care Staff)

Education%20Day%20Care%20Building%20Block%20F.jpg

The State of Ohio has filed a lawsuit against one of the largest day care center chains in the State alleging that Angels Learning Center failed to pay many of its child care workers according to the wage guidelines set by the state. The lawsuit was filed by the State Attorney General Office and the Department of Commerce. It was reported that 150 employees were not paid the wages that they were entitled to under the law.

What are the dangers of underpaying child care staff? It is not a good sign that a day care center is cutting corners by failing to pay its staff according to the laws. It makes one question, "What other corners are being cut by the day care center?" If funds are not spent paying the employees even minimum wage, "What funds are being expended for training, safety, and other important facets of the day care center?"

Day care centers / child care centers in Ohio and other states should properly pay its employees. Furthermore, these facilities should show a greater concern for day care workers / child care workers who are so vital in the proper supervision and care of children.

In California and other States, parents send their children to school with an expectation that there will be supervision and instruction in a safe learning environment. In Bakersfield, California, a sixth grade teacher was recently arrested for intoxication. The teacher was removed from the school in handcuffs. Science teacher Larry Michaels was arrested at the school during lunch time. Mr. Michaels was evaluated by deputies who determined that he was under the influence of alcohol and possibly prescription medication. Mr. Michaels reportedly refused testing. Like any other criminal defense case, Mr. Michaels will be entitled to a defense on this matter.

Teachers, day care workers, and child care providers need to be alert and awake when supervising our children. Alcohol and drugs dull the senses and certainly do affect a person's judgment and ability to respond physically and mentally timely and appropriately during child care.

National Highway Traffic Safety Administration "Reversible Power Windows" Are Not Necessary

The National Highway Traffic Safety Administration (NHTSA) conducted a study to determine the necessity of requiring vehicles to have reversible power windows as a safety requirements for passenger vehicles. The NHTSA determined that safety measures were already in place for the protection of children. These safety measures make it more difficult for a child to engage a power window. Unfortunately, even with safety measures in place, children are still being harmed or injured every year by vehicle power windows from strangulation and trauma. The NHTSA did recommend on some vehicles that reversible power windows which automatically reverse when an obstruction is sensed. The NHTSA reported that every year there are approximately 6 deaths and almost 2000 injuries from power windows. The technology is available to install reversible windows and the cost of such an important safety measure ($6 to $12 per window) seems to be minimal in light of the serious injuries and wrongful deaths that can be avoided through such a safety measure. Hurricane Generated Wave Sweeps 7 Year Out to Sea

Hurricane%20Cloud%20Winds%20and%20Injuries.jpg

A large wave fueled by Hurricane Bill swept three people from the rocks at Thunder Hole in Acadia National Park in Bar Harbor, Maine on Sunday, August 23, 2009. The Coast Guard pulled a 7-year old New York City girl, her father, and a 12-year old Belfast, Maine girl from the water. The 7-year old had no vital signs and could not be resuscitated. Both the man and the 12-year old girl are hospitalized, the man with a heart condition and the girl with a broken leg. Nine others also were hospitalized, mostly with broken bones from being slammed into the rocks. Officials did not release names of the victims. You may read more of the story at http://www.bangordailynews.com/detail/117347.html.

Hurricane Bill passed approximately 300 miles offshore of Maine on Sunday. The National Weather Service had earlier posted dangerous surf advisory. A wave monitoring gauge recorded 17-foot seas at Mount Desert Rock 40 miles offshore.

Thunder Hole is a deep, steep-sided crevice formed in a granite cliff. At the end of the crevice is a small cavern. When a wave rolls in, it forces air and water from the crevice producing a sound like the clap of thunder. Often it throws a huge spray into the air. You may view a video of Thunder Hole.

According to a park Ranger, as many as 10,000 people lined the shore on either side of Thunder Hole Sunday. People were attracted to Thunder Hole because of the combination of high surf from Hurricane Bill and high tide.
