Grove, Oklahoma – Eleven-year-old Boy (Troy Helms) Attacked by Great Dane

Troy Helms, an 11-year-old from Grove, Oklahoma was attending the Strut Your Mutt dog walk sponsored by the Humane Society of Grove and Grand Lake when he accidentally fell on the ground. A Great Dane attacked the child, biting down on his face and neck. The boy received more than 100 stitches.

Witnesses say that the dog’s owner simply loaded his dog into his vehicle and left the scene. He was later cited by police for the attack.

When owner’s take their dogs into public, they are liable for the actions of the dog. While animals are by nature unpredictable, an owner who suspects that his dog might behave aggressively in public has a legal and ethical responsibility to protect the public from the dog, whether that means leaving the animal at home or fitting it with a muzzle. They should certainly not bring the animal into a crowded event where there are children present. The story does not mention if the child’s family will file a lawsuit against the dog’s owner or the humane society, but they are certainly within their rights to do so.

Simple Tips for Keeping Kids Safe This Halloween

Keeping kids safe while still having fun is an important goal for parents on Halloween. A few simple precautions can keep kids safe:

• Have kids trick or treat together in groups with plenty of parental supervision
• Make sure kids have a good meal before they go out, so they’re not tempted to eat the candy before parents have a chance to check it for them
• Only knock on doors with the porch lights on (registered sex offenders are required to keep their porch lights off on Halloween night)
• Give kids glow sticks, flashlights, or reflective tape to wear on their costumes
• Homeowners are reminded to keep their front door well lit and free of obstacles

Some parents are keeping kids safe by skipping trick-or-treating all together, opting for Halloween parties or trick-or-treat events at malls and churches.

Bear, Delaware - Boy Suspended For 45 Days for Taking “Spork” to School, Allowed to Return to Class

Zachary Christie, a six-year-old first-grader, was suspended and was facing 45 days in an alternative school for troublemakers for taking his favorite camping utensil to school. The utensil was a combination knife/fork/spoon that the child had planned to use to eat his lunch. The child was expelled under the school’s guidelines for dealing with children who bring weapons to school or commit violent offenses.

After public outcry, the school board voted to change the penalty for kindergartners and first-graders to a 3-5 day suspension. Zachary’s punishment was one of many recent incidents that have called into question schools’ zero-tolerance policies.

Of course, the school district has a responsibility to protect students from weapons and aggressive behavior. They can be held liable if a student in injured while at school. But the need for common sense to take precedence over blindly following the letter of school policy is obvious in this case. Assessing incidents on a case by case basis rather than reacting to all incidents with the same harsh punishment actually creates a safer and more stable environment for children.

Mother Suggests Ways of Protecting Special Needs Children from Predators

The mother of a special needs child and active blogger has come out with a list of actions parents of special needs kids can take to protect their children from predators. She suggests that parents teach their special needs children the following:

• It is not appropriate for an adult to ask a child for help. Respond to requests with “Let me get my Mom or Dad.”
• Always let a parent or responsible guardian know where you will be and check in frequently.
• Make sure the child knows your home address and contact information. If the child has trouble memorizing this information, a laminated card or metal tag (worn out of sight) may help.
• Think about giving the child a cell phone with your number and any emergency numbers programmed in.
• Make sure the child knows how to dial 911 in an emergency.
• Have a special word that only trusted family members know. Let the child know not to go with anyone who doesn’t know the special word.
• Make sure the child knows not to go near strange cars or strange people.
• If the child is alone, scared or in trouble, teach them to ask for help from a mother with children, even if she is a stranger. This is the safest stranger for him to ask for help.
• Parents should always have a current photo of the child and make a mental note of what they are wearing each day.
• If your child is missing, contact authorities and ask them to enter your child’s information into the National Crime Information Center’s Missing Person File. Then call the National Center for Missing and Exploited Children at 1-800-THE-LOST.

While these guidelines were developed for parents of special needs children, most of them are applicable to any child. The best defense against predators is a good offense – that means teaching your child how to be safe.

Gang Rape Horror Outside of Homecoming Dance (Richmond, California) Police Estimate that As Many As 20 Were Present

In Richmond, California, police and investigators continue to search for witnesses and participants in a horrendous gang rape incident that took place outside of a homecoming dance. Police recently reported that at least 10 participated in the assault while 10 others watched. What a terrible and unforgivable incident? The ten who participated are criminals and should serve time for their crimes. The victim was 15 years old. An interesting law passed in 1999 in California makes it a crime for the failure to report a crime committed against a child 14 and under. While the witnesses may not have committed a crime under this law, their lack of action and contribution as spectators should certainly be scrutinized and categorized as a crime if possible under other California statutes, ordinances, and / or case law. Forensic evidence has been collected which includes DNA evidence of several of the criminals involved in the assault. It was reported that the assault took place over a 2 1/2 hour time period. Even the Richmond, California School District has admitted some liability for these acts by the statements of Charles Ramsey, a member of the Richmond School Board. Mr. Ramsey stated that the school district bears some responsibility for the attack (assault) based on the lack of or inadequate supervision in the area of the attack. 17 Year Old Boy From South Jersey Dies from H1N1 (Swine Flu)

In New Jersey and other States, reports of fatalities from H1N1, commonly referred to as the Swine Flu, continue. Just recently, a 17 year old boy from South Jersey died from complications related to H1N1. The death was reported at the Asbury Press (New Jersey) Website. The boy was a student at Rancocas Valley Regional High School in Mount Holly, New Jersey.

Health experts state that children, pregnant women, and others with a compromised immune system are most at risk for serious illness and death from H1N1. Some children and adults with H1N1 have mild, temporary symptoms that come and go in just a few days. While others especially children and pregnant women are suffering far greater effects and consequences form the Swine Flu. The Roman Polanski Case and a Voice of Reason . . . Howard Stern

The Roman Polanski case has brought out comments and opinions from politicians, public figures, movie industry executives, and celebrities including but not limited to Howard Stern. Many people find Howard Stern to be controversial. Some find him to be rude. What many do not know about Howard Stern is that there is often times a serious side or serious message to his satellite radio show played on Sirius Satellite Radio. Some times in life, it is important to pay more attention to the message rather than the messenger. Howard Stern and his on-air colleagues at Sirius were on the right mark with Roman Polanski. Rather than focus on Polanski's life achievements, work, and talent as a director, Howard Stern focused on the crime itself. The bottom line is that Roman Polanksi raped a 13 year old girl. The crime, whether it happened yesterday or 30 years ago, warrants a prison sentence in the State of California and some justice. Study Shows Disadvantaged and Special Needs Children More Likely to Be Suspended or Expelled

While the total number of children being suspended or expelled has actually dropped in recent years, a study from Great Britain shows that children with special needs, those who qualify for free lunch programs, and those from ethnic minorities are sent home eight times more often than their peers. The study also noted that boys were three times more likely than girls to be suspended or expelled from school.

While this study was done in Great Britain, it would not be surprising to see the same trend in schools in the United States. Children with special needs and those from economically challenged families are often more likely to have disciplinary problems, and schools and teachers that are ill-prepared to handle them often resort to expulsion rather than taking the time and care needed to educate these children.

Posey County, Indiana –9-year-old Boy Killed in All Terrain Vehicle (ATV) Accident

Phillip Gross was driving an ATV on Maier Road, South of Mount Vernon, Indiana with two children, aged 9 and 12, as passengers. Gross reportedly hit a dog, causing the ATV to rollover, trapping Gross and the 9-year old under the vehicle. According to deputies of the Posey County, Indiana Sheriff’s Office, the boy died shortly after being transported to Saint Mary’s Hospital by Life Flight. Gross and the twelve-year-old girl were treated and the girl has been released.

ATVs are open motorized vehicles that can flip over, causing serious injuries or death to children and adults alike. Adults should take care when driving ATVs and make sure that they and their passengers observe safety precautions such as wearing safety helmets. Baby in Baby Stroller Miraculously Survives Train Collision in Melbourne, Australia - Amazing Video

In Australia, an amazing video captured a near tragic incident involving a train and a baby in a baby stroller / carrier. Video footage from the station's security camera captured this incident. It is truly incredible that the baby only suffered minor injuries. The baby, who was only 6 months old, somehow avoided serious personal injuries. Any parent watching this video should take notice and make sure that children are safe and away from the dangers of moving trains, buses, and cars when children are in public. Jacksonville, Florida – Mother of Two Beats Child To Death With Fly Swatter While Babysitting

Two-year-old Amara Ou, of St. Johns County, Florida, was murdered in her babysitter’s Mandarin, Florida home nearly three years ago. The child was beaten with the handle of a fly swatter, and died of severe head trauma at Wolfson Children’s Hospital three days later. The babysitter, Syna Lim, 41, is a mother of two children herself. Last month a jury convicted her of first degree murder and aggravated child abuse. Ms. Lim was given the mandatory life sentence for her crimes.

There is no doubt that the loss of their daughter was made even more difficult for the Ous because she was killed by someone they trusted. Parents shouldn’t have to worry about a caretaker, especially a trusted family friend, beating their child while they are out. While the Ous feel that justice was served, the entire incident could have been avoided if Lim had declined to watch the child or been able to calm herself when she became annoyed with the child.

Great Falls, Montana – Teachers’ Aids (Julie Parish and Kristina Marie Kallies) Accused of Abusing Autistic and Other Special Needs Children

Five families from Great Falls Montana believe that their special needs children were severely abused by the 7th and 8th grade special needs classroom teacher aids at North Middle School. Tragically, the children’s special needs – autism, cerebral palsy and down syndrome – prevented them from reporting the alleged abuse. Julie Parish and Kristina Marie Kallies have been charged with felony assault on a minor and misdemeanor endangering the welfare of children. Ms. Parish has been arrested but police have been unable to find Ms. Kallie.

The children’s parents are both outraged and heartbroken. The parents reported that their children would come home from school with bite marks, burns and welts. Witnesses claim to have seen children water boarded, forced to eat their own vomit, and left sitting in soiled clothing for several hours.

How Parents and Daycare Centers Can Help Prevent H1N1 Breakouts

Millions of parents rely on daycare centers to look after their children. But with the looming H1N1 epidemic, daycare centers could become breeding grounds for the potentially deadly virus. I recently had the opportunity to share my legal viewpoint about the ramifications of H1N1 and daycare center liability with Time Magazine.

If a child contracts H1N1 at a daycare center due to negligence on the part of the daycare, the parent could sue; especially if the disease led to hospitalization, permanent injury, or death. To protect themselves and the children they are caring for, daycare owners and managers need to take an active approach to keeping kids with H1N1 symptoms away from the daycare center and following proper sanitation procedures in the center.

To protect their children, parents need to understand that not all licensed daycare centers are compliant with the terms of their license, and that church-based daycare centers may be exempt from state regulations. Parents can be proactive by checking into the background and cleanliness of the daycare center where they leave their children.

Alamo, Tennessee – Owner Pleads Guilty to Neglect Charges after Daycare Fire

In December 2008, an electrical space heater caused a fire at the Heavenly Angels Daycare in Alamo, Tennessee. The fire injured three children: two two-year olds and a three-year old. The children were rescued from the fire by Alamo Assistant Chief Kevin Sugg, who was off duty at the time. All three were treated for smoke inhalation, and the three-year old also had burns on his face. The owner, Kathy T. Humphrey, was charged with child abuse and neglect of a child under the age of six.

At the time of the accident, Humphrey and two other women had already been cited by the Tennessee Department of Human Services for operating a childcare agency without a license. Humphrey pleaded guilty to the abuse and neglect charges and was placed on unsupervised probation. The standard two-year sentence was suspended.

Daycare centers should be a safe and loving place for children to go while their parents are at work. This case highlights how important it is for parents to thoroughly check into their daycare provider’s reputation, facilities, and license status. If a parent finds that a daycare center is operating without an appropriate license, they should report them to the proper authorities so that tragedies like this one can be avoided.

Panama City Beach, Florida – Parents on Drug Binge Wrap Injured Child in Duct Tape

The Bay County Florida Sheriff’s office reported that a baby who suffered a head injury was wrapped in duct tape and left to suffer while his parents “tweaked” on crystal meth. The parents, John Paul Huskey and Jessica Huskey have both been charged with aggravated child abuse, and the pair may also be charged with several drug offences. According to Captain Faith Bell of the Bay County, Florida Sheriff’s office, officers also found evidence of crack and marijuana in the couple’s home.

According to the parents, the child was injured when John Paul Huskey jumped on a chair, which broke and struck the child in the head. However, authorities are still investigating the cause of the injury. Even if the injury was an accident, the parents' subsequent actions still constitute a felony. Neither of the parents ever called for help, the incident was phoned in by an anonymous tipster.

This arrest highlights the detrimental effects that drugs can have on a parent’s abilities to care for a child. Had the parents not been binging on drugs, the accident probably would not have even taken place. It is alarming that parents would choose drugs over the life, safety, and welfare of their own child.

Orosi, California - Mother Found Guilty of Child Abuse, Murder

It took less than one hour for a Tulare County jury to return a guilty verdict in this shocking California case. Nancy Ortiz, 24, of Orosi, California was found guilty on second degree murder and felony child abuse charges after she abandoned three of her children.

Two of the children were found alive and have been placed in foster care. The third died of exposure and was found in the bed of a pick-up truck. She was also convicted of misdemeanor child abuse after another of her children was found wandering the streets alone in nothing but a diaper. Ortiz will be sentenced on December 9th, 2009, and could serve over 22 years in prison for her actions.

Advice for Parents - Factors to Determine - When Should a Parent Take a Child to the Emergency Room (ER)?

Parents can sometimes have a hard time determining when it is appropriate to take a child to the emergency room. CBS News medical correspondent and pediatrician Dr. Jennifer Ashton recently outlined some pointers for parents to recognize when an illness or injury is an emergency.

For Babies:
Look for changes in the baby’s day-to-day habits such as:

• Eating habits: Have they started eating a lot more or a lot less than normal?
• Frequency of bowel movements or urination: drastic changes that happen the same time as a change in eating habits can signal a serious problem.
• Amount of sleep: a baby that has stopped sleeping or sleeping much longer than usual can be a sign of serious illness.

Another signal of something serious is if your infant cries for more than three hours in a row. If the crying does not seem hysterical or inconsolable, a call to the doctor is in order. Otherwise a trip to the emergency room is warranted.

For Toddlers and Older Children:
If your child is injured in an accident, consider the “mechanism of injury.” For example, tripping over a rug will likely result in a much less serious injury than falling out of a window. This information will help you determine how serious their injury is likely to be.

Next, consider the ABC method:

• Airway: Kids can usually catch their breath quickly after an accident. If their breathing does not sound normal to you, consider a trip to the ER.
• Bleeding: If the wound does not show signs of clotting, if it seems very deep, or is more than ½ inch long you should visit the ER right away.
• Color: If your child’s color looks off, especially blue, yellow or grey, it can be a sign of internal injury and you should get them to an emergency room as soon as possible.

Another important indicator is your child’s mental status. If he babbles, is incoherent or delirious, this can be a sign of a high fever or meningitis.

If a parent has concerns about the health of a child, it is always advisable to be very cautious and diligent with medical care and follow up which may involve or require an ER visit.

Study Shows That Over Half of Children in the United States are Exposed to Violence

A newly released US government survey, Children's Exposure to Violence: A Comprehensive National Survey, has revealed that 60% of American children under the age of eighteen have been exposed to violence in the last year. For nearly 50% of the children, the violence came in the form of an assault. The other 10% were subject to physical and emotional child abuse, child neglect, sexual abuse and even parent abduction. Frighteningly, the study revealed that once a child was exposed to violence, they were more likely to be exposed to additional violence.

This study highlights the need for a coordinated effort between government agencies, teachers and police to identify children who are at risk and those who are already suffering the effects of abuse. There is also a need to improve services to help the victimized children and break the cycle of abuse.

Lake Elisnore, California Day Care Center Shut Down - Marijuana and Bomb Making Have No Place in a Day Care Center

In California and other States, day care centers should be places of safety and education for children. Day care centers should not be places for illegal drugs or bomb making materials. The California Inland Island Child Care Regional Office recently ordered the closure of a day care center with such criminal activities. The Kuzelka family operated a day care center but did not limit their business or entrepreneur activities to child care. Law enforcement officials found bomb making materials and marijuana at the home / day care center as part of an investigation following a report that Benjamin Kuzelka blew off most of his hand Wednesday night with a liquid explosive that he was making in his garage.

It is abundantly clear that bomb making materials and illegal drugs can lead to dangerous incidents and personal injuries involving children. Criminal activities often times lead to violence, altercations, stabbings, and shootings. Furthermore, the volatile nature of bomb making materials can lead to explosions that can pose a danger to children.

Parent's Viewpoint - BB Guns / Pellet Guns / Air Soft Guns Should be Illegal for Children

An interesting article regarding BB guns was posted at the Mom Logic website. The author of the article advocates for banning the use of BB guns for children. Many parents and gun advocates would argue that BB guns (as well as regular guns) are fine in the hands of children who are trained and supervised in the use of these toys / weapons; however, as the article in Mom Logic points out, BB guns can be very dangerous and can even cause death in some instances. Some argue that the benefits and joys of shooting a BB gun are far outweighed by the dangers which can include serious personal injuries and, yes, even death. Another problem with BB guns and other air soft guns is that police and law enforcement often mistake these guns for more dangerous or powerful weapons. State of Massachusetts Plans to Require Toothbrushing at Day Care Centers and Pre-Schools

The State of Massachusetts - Department of Early Education and Care plans on requiring day care centers and pre-schools to supervise toothbrushing of children. This plan will apply to young children who are under supervised care for more than 4 hours per day. Parents can opt out of this requirement if they choose. The new requirement for day care centers is aimed at preventing the ongoing problem of tooth decay in your children. The Division of Emergency Medicine for Children's Hospital Boston completed a study regarding child injuries and glass table tops. The study was a collaboration with Consumer Reports. The study concluded that the incidence of glass table top injuries were higher than anticipated. It was the conclusion of the doctors involved with the study that safer glass table tops would have avoided the incidence or number of these injuries. Corporal Punishment and Child's IQ - Is There a Relationship Between Spanking and IQ?

In the United States, there has been a debate for years as to the parents right to inflict corporal punishment upon their child. Some parents use corporal punishment because that is the way the parent was raised. Other use it because there is a belief that corporal punishment shows authority and to some love. Yes, some believe that corporal punishment is an act of love that parents show to their children that the parents care. There can be a number of reasons that a parent inflict corporal punishment upon a child. Many safety child advocates believe that corporal punishment is just another mode of domestic violence. Children should not be subjected to injury or harm from corporal punishment. To many, corporal punishment is just a lazy, outdated, and barbaric way to discipline a child. A study conducted by Murray A. Straus (University of New Hampshire, Durham, New Hampshire) and Mallie J. Paschall (Prevention Research Center, Berkeley, California) indicates that there may be a link or association between corporal punishment / spanking and a child's IQ.

Corporal punishment is harmful to children and often times results in physical and emotional injuries. According to this study, children may also suffer from a lower IQ when being raised by a parent who frequently resorts to corporal punishment. Whether corporal punishment leads to lower IQ or not, there are far too many repercussions and dangers from corporal punishment for parents to keep on turning to this type of discipline.

A medical study estimates that burn injuries to children happen every 60 seconds in the United States. Approximately 300 children suffer burn injuries every day. Nationwide Children's Hospital based in Columbus, Ohio conducted the study which yielded important information that every parent, caregiver, teacher, and day care provider should know. A researcher for the study stated that most of the children (60 %) were under the age of 6 years old. This is not surprising in that children under the age of 6 do not have the safety awareness or judgment of an older child. The study spanned 17 years and studied information regarding more than 2 million burn injuries.

Fabens, Texas 2 Year Old Suffers Serious Burn Injuries - Dangers in the Kitchen from Boiling Water and Hot Food Products

In Fabens, Texas, a 2 year old child suffered serious burn injuries in the kitchen of his home. According to a story posted at the KDBC CBS 4 News website, the mother had placed a water on the stove for heating. Thereafter, the mother put the pot on the table as she was getting ready for work. Just a few moments of inattention resulted in injuries of a 2 year old who knocked the pot of water over. Deputies later arrived on the scene to find this child with serious burn injuries from the hot water.

Parents, especially working and single parents, have a lot of responsibility. Distractions happen every day. Nevertheless, it is vital for parents to be super diligent when there are any risks or dangers to children. Many people do not believe the a child can be harmed in the safety of the child's own home. When selecting a day care facility / child care facility, parents should ask many questions. Parent should look for a facility with a well maintained and with a well staffed facility. Facilities that follow the rules and regulations are more likely to pay closer attention to child safety issues and precautions. Lawrenceburg, Tennessee - Father Allegedly Breaks 4-month-old Son’s Arm

Philip Blake Putnam, 22, was charged with aggravated child abuse after his son was taken to the hospital with a broken arm. While the baby is still in the hospital and is showing signs of improvement, Putnam remains in jail. According the Lawrenceburg Police Chief, after arresting Putnam, he discovered that the man was wanted under several active arrest warrants for drug-related charges in another county.

It is sad to think that a father, no matter what his substance abuse problems, would lash out at an infant in this way. It is also sad to realize that if the police had been able to find Putnam and arrest him on the drug-related charges, his son might have been spared the physical abuse from his father. Parental abuse is devastating for young children, who suffer emotional, physical and psychological scars for the rest of their lives.

If Putnam is found guilty of aggravated child abuse, he could face up to 30 years in prison for the crime.

Georgia Supreme Court Finds Atlanta City Ordinance Banning Young Strippers Unconstitutional

The Georgia Supreme Court has found an Atlanta City Ordinance that prohibits erotic dancers between the ages of 18 and 21 from entering the premises of adult entertainment establishments unconstitutional. The plaintiffs in this lawsuit were young dancers between the ages of 18 and 21 who challenged the constitutionality of the statute. The dancers wanted to work as strippers at a long time Atlanta establishment, the Cheetah Lounge. Under the Atlanta ordinance, however, they could not enter the premises.

The Georgia Supreme Court found that the city ordinance was pre-empted by state statutes which allow young people between the ages of 18 and 21 to work in jobs which require them to serve alcohol. By analogy, apparently, young people between the ages of 18 and 21 should also be allowed to work as strippers in adult entertainment establishments.

Alabama Driver Arrested for Having Teen Ride On Top of Van

In Alabama, a mother was arrested for having her teenage child ride in a cardboard box on top of a van. The driver, Jackie Denise Knott, informed Albertville, Alabama police that she had a good reason for placing her teen on top of the van. The reason was that the driver needed someone to hold down a box. Here is a better idea for this driver: leave the box and avoid putting a child at risk for personal injuries. Several drivers had called in this dangerous situation to police.

Parents do not always use good judgment in operating motor vehicles or supervising their children. Many children have been injured when riding unrestrained in the back of a pick up truck. While not many children are spotted riding on the top of a van, it is quite dangerous for the child. Fortunately, the teen was not seriously injured in Alabama. However, circumstances could have taken place that would have lead to serious personal injuries. A simple rear end accident or the wind or force from a passing semi tractor trailer could have turned this odd story into a tragedy. Massachusetts Day Care Regulations - Should the State Impose Regulations Regarding Supervision, Progress and Documentation?

The State of Massachusetts is imposing new requirements on day care providers including in home day care providers. Opponents argue that the regulations and restrictions put a heavy burden on small day care providers. Advocates of such regulations including the State of Massachusetts point out that the regulations help provide for and promote the safety and well being of children placed in day care centers throughout the State. The changes to Massachusetts law will take effect in January 2010. An article posted in the Boston Herald covers the new laws and seems to make more of an argument against the regulations.

Many day care operators, who voice opposition to regulations and standards, just do not want to follow them. It does not seem to be much of a burden to require day care centers to have periodic progress reports on file for each child in the day care center. Day care centers should be held accountable and this kind of regulation helps authorities inspect and review care provided at a day care center.

5 Year Old Child Dies in ORV (Off Road Vehicle) Accident in Iron River Township, Michigan

In Iron River Township, Michigan, a 5 year old died in an ORV (Off Road Vehicle) accident. The accident took place on Amvets Highway in the morning. The driver of the ORV was Kimberly Lewis, a 36 year old woman from Larsen, Wisconsin. Ms. Lewis suffered a leg injury. The child, who was wearing a helmet, died as a result of the accident. Trampoline Accidents and Personal Injuries to Children - Duty to Maintain and Duty to Supervise

In the United States, United Kingdom (England), and many other places, children love to play on trampolines. Unfortunately, children are injured on injuries every day. Many injuries can be avoided with better safety precautions and supervision. Children, especially young children, lack safety awareness. This is especially true when playing on trampolines. Jumping on a trampoline can be quite empowering for a child. Children often want to jump higher and higher. Children then try tricks like flips and jumping in and around each other. During these stunts or just regular jumping, children are injured.

One safety precaution that is vital is a safety net. Every trampoline should have a properly installed safety net. Furthermore, all trampolines should be assembled per manufacturer instructions and placed on a flat secure area. Thereafter, trampolines should be inspected and maintained on a regular basis. There is no substitute for proper adult supervision as well. Trampolines that are properly maintained with safety nets are still hazards for children if there is no adult supervision. Dolton, Illinois - Special Needs Child (Marshawn Pitts) Assaulted by Police Officer

In Dolton, Illinois a special needs child was assaulted by a police officer, at a school. The police officer's actions and abuse were captured on videotape. Apparently the police officer became upset when the special needs child, Marshawn Pitts,15, had his shirt untucked. The fact that this child's shirt was untucked became the reason for this inexcusable assault on a brain damaged child is beyond comprehension.

Both public and private schools should be safe havens for children. This is especially true for young children as well as special needs children. It is important for a child to know that school is a place for learning and nurturing rather than a place for violence, assault, battery or attack.

The police officer ulitmately resigned over this incident. There was a videotape of the assault of this special needs child. Unfortunately, many personal injuries and attacks on children in the Illinois school system are not addressed by the action of removing the attacker from the school. Furthermore, many attacks go unnoticed and are not videotaped. As such, there are a great number of other attacks on school-aged children that school officials, parents, teachers, law enforcement and the community do not learn about.

Hawthorne, California - Day Care Owner Convicted of Lewd Acts on Two Girls at Day Care Center

In Hawthorne, California, a jury recently convicted an owner of a day care center of lewd acts on two young girls (ages 4 and 6). According to CBS News, Tito Ruiz was found guilty of the crimes. The criminal investigation and trial revealed allegations by two girls who reported that they were touched by Mr. Ruiz while at the day care center. All of the details of the trial were not reported. In cases of this nature, it would be important to know the following:

What kind of criminal background (if any) did Mr. Ruiz have prior to these reported incidents?

How many times did Mr. Ruiz inappropriately touch or molest the children?

What evidence was presented as to the crimes? Testimony of the children?
Photographs? Videotape? Medical examination? Forensic evidence?

Did Mr. Ruiz testify at trial?

Did any employees of the day care center testify at trial?

Day care center should be a haven of safety for children. Unfortunately and tragically, many day care centers are the sites of abuse, neglect and molestation for children who are unable to defend themselves against such predators.

Arlington, Texas Mother Charged in Death of Toddler Who was Left In Hot Car for 8 Hours

An Arlington, Texas mother has been criminally charged for the death of her 1 year old son. Darrell "Tre" Singleton, III, had a body temperature of 107 degrees when he was evaluated and pronounced dead at Arlington Memorial Hospital. Police investigators and local authorities believe that the death was a direct result of the mother leaving Darrell "Tre" in a vehicle for 8 hours while the mother worked at a local hospital. The mother (Keashia Dyon Matthews) turned herself into local authorities for the charges and later was released on bond. Ms. Matthews had a history of parenting issues with her children.

Poor judgment on the part of parents and child caregivers often times leads to serious personal injuries and death. Children especially infants and toddlers should not be left unattended in vehicles. The extreme heat or cold can lead to devastating injuries and some times death. Even if the temperature is moderate, there are other risks involved in leaving a child in a vehicle unattended or in any other area unattended.

Common Injuries Sustained by Children Playing Lacrosse

Lacrosse is a sport that increases with popularity each year. Due to the contact nature of the sport, there have been a number of reported injuries to children and young adults every year resulting from Lacrosse. David Marshall, M.D. recently posted an article about child injuries and Lacrosse. Dr. Marshall is the Medical Director of the Sports Medicine Program for Children's Healthcare of Atlanta. He also serves as Clinical Assistant Professor at Emory University School of Medicine in Atlanta Georgia. Dr. Marshall noted that approximately 300,000 children play Lacrosse and it is one of the fastest growing sports in the United States for boys and girls. The type of protective gear typically used by boys is different than that for girls. Many girl clubs and teams do not wear helmets or the protective gear when body checking is not permitted. Due to the potential contact and injuries that may be inadvertently caused by the Lacrosse stick and ball, some safety advocates may argue that it is better to have all available safety equipment in use even if the risks of injury is low when body checking is not permitted. Reported injuries from Lacrosse include abrasions, contusions, muscle and tendon strains, shin splints, fractures, and facial injuries. Wisconsin Parents To Be Sentenced for Death of Child - Freedom of Religion versus Child Neglect

In Wisconsin and other States, parents, as well as children, have a right to pray and to practice religious beliefs of a particular religion. The State and Federal government generally should allow people to pray and pay respect to a particular religion or practice without interference. Yes, we have the United States Constitution which has granted people the freedom of religion; however, when a child's health, safety, and well being were put at risks, law enforcement authorities and prosecutors have taken action. In Wisconsin, parents were prosecuted for the 2003 death of their 11 year old daughter who died without the benefit of timely medical intervention. Instead of taking their daughter to the hospital, Dale and Leilani Neumann prayed along with ohters. Their daughter, Madeline Neumann, died from complications related to undiagnosed diabetes which is typically a condition that can be managed through medication and / or dietary intake. Madeline died on the floor of the family home. 911 was called only after Madeline stopped breathing. This case garnered national attention because there are thousands of other parents who may take a similar route to the Neumanns in dealing with a life threatening but treatable condition.

School Bus Accident - Opp, Alabama - Child Injuries and Driver Safety

In Opp, Alabama, two children were taken to the Opp (Alabama) Mizell Memorial Hospital for personal injuries that were sustained in a school bus accident. Another student was later transported to the hospital by a school staff member. The other vehicle involved in the accident crashed into the side of the bus as the bus was turning. The driver of the other vehicle had to be removed or extracted by the vehicle by a jaws of life device.

School buses populate our roads mostly in the early morning and mid to late afternoon hours. All drivers should proceed with caution and slow their speed down when driving near a school bus or a school bus stop. Far too many injuries are sustained by children riding school buses every year. Baby Sitter Criminally Charged in Infant's Death - Shaken Baby Syndrome in Des Moines, Iowa

Unlicensed day care providers and unlicensed in home day care centers can prove to be places of danger, injury, and even death for children. In Des Moines, Iowa, a 4 month old child was seriously injured when a grandmother went to the in home day care center to pick up her grandson (Emiliano Ramirez of Urbandale, Iowa).

Medical providers at Blank Children's Hospital later diagnosed the child with retinal hemorrhages and bleeding of the brain. Typically, these condition results from Shaken Baby Syndrome.

Due to the medical condition of the child which appeared to result during a time that he was under the care of a day care provider, criminal charges (felony child endangerment) were filed against the day care provider.

The detective said Emiliano's grandmother picked him up at Watts' residence on Sept. 15, and because he looked pale, was taken to Blank Children's Hospital. The South Carolina Department of Social Services Cites Day Care Center for Violations

The South Carolina Department of Social Services is the state agency that regulates and licenses day care centers in the State of South Carolina. It has been reported that Little Scholars Child Development Center based in Columbia, South Carolina has been cited with a number of day care / child care violations. This day care center was recently in the news for allowing 4 toddlers to play near a busy roadway. News 19 - South Carolina discovered that this day care center had been cited 10 times for violations since December 2009. Due to the number and severity of violations, the Department of Social Services issued a letter to the owner of the day care center instructing the owner to comply with a corrective plan of action. Design of City, Roads, and Playgrounds Can Reduce the Incidents of Child Injury and Accidental Death

Dangers to Children - Parked Cars and Traffic - 10 Year Old Allentown Pennsylvania Boy Hit by a Car

In Allentown, Pennsylvania and cities across the nation, there is a common danger to children: parked cars and traffic. When cars are parked on the side of a street, it may be difficult for a children to see oncoming traffic. In addition, drivers may not see children who walk between parked cars into a street. A 10 year old boy in Allentown, Pennsylvania was recently hit by a car as he walked between two parked cars. The boy was taken to and treated at Cedar Crest Hospital. He suffered a severe personal injury to his leg. Local police will conduct an investigation as to the cause and manner of the accident.

Incidents like this are valuable teaching tools for parents, caregivers, day care providers, and teachers to use when speaking to children about traffic and pedestrian safety. In Wilmington, Delware, a 19 month old boy wandered away from a day care center. He was found crawling on a sidewalk near a busy intersection. In Delaware and other States, there is a problem with day care supervision of children. Fortunately, ths child did not suffer any serious child personal injuries. The fact that the child was not injured does not excuse the failure to supervise and the failure to have safety precautions in place to prevent this incident from taking place. It was reported that a parent may have left a gate open. Since parents are not trained in day care supervision or facility safety, it is the responsibility of the day care operators and staff members to make sure that safety precautions are in place that account for acts that a parent may take while at the day care facility. Supreme Court of of the United States Denies Catholic Church Request to Block Release of Sexual Abuse / Molestation Papers

The Roman Catholic Diocese in Bridgeport, Connecticut sought to block the release of documents related to a number of sexual abuse / molestation cases previously brought against the church. The documents related to lawsuits that were settled by the church in the past. Newspapers had previously sought to obtain access / release to more than 12000 pages of documents from 23 lawsuits that were filed based on the alleged actions of six priests. The records have been sealed since the cases were settled in 2001. The release of these documents may help publicized prior bad acts of priests and may, in turn, encourage other victims to step forward. Clayton County, Georgia Mother Convicted of Starving Twin Babies

A Clayton County, Georgia jury found a mother guilty on October 1, 2009 of eight criminal charges, including cruelty to children and contributing to the deprivation of a minor for starving her twin infant sons. The mother and the boys’ father were high on Methadone and other prescription drugs as well as alcohol and were not able to care for the babies. Relatives of the babies intervened—except for the maternal grandmother, a former special education official, who failed to report the child abuse. The grandmother will be tried on criminal charges later this month.

By the time authorities intervened, the 13 month old babies were severely malnourished. The mother blamed her sons’ pediatrician, claiming that the doctor did not tell her what and when to feed the babies. Apparently, the mother believed that it was appropriate childcare to go for literally days without feeding the infants.

The boys now live with their paternal grandmother and aunt. According to the paternal grandmother, the boys are developmentally delayed and suffered brain damage as a result of the abuse.

Man Charged with Dealing Drugs Near Indiana Day Care Center

In Indiana and other States, crimes are considered enhanced crimes or more serious crimes when committed near a school and / or day care center. In Lafayette, Indiana, a man was recently arrested for dealing drugs within 1000 feet from a day care center. Further investigation by police officials uncovered a drug operation involving the growing of marijuana and the selling of LSD. In addition, police officials found several guns. The safety of children were certainly at risks when drugs are being sold nearby. Drug sales lead to other criminal activity including but not limited to assault, battery, shooting, and other violent crimes. Playground Slide Injuries and Children - Dangers of Sliding Down Slide with Your Child

Playgrounds are present in every community and most every elementary school in the United States. Most playgrounds are equipped with a slide. Unfortunately, children suffer injuries when using playground equipment including swings, ladders, monkey bars, slides, and other areas. With respect to slides, many parents and caregivers enjoy sliding down slides with small children on their laps. A medical study conducted by John T. Gaffney, D.O., Orthopaedic Surgeon with Winthrop Orthopaedic Associates in New York was reported in the Journal of Pediatric Orthopaedics. Dr. Gaffney studies the relationship between child injuries on playground slides and the cause or mechanism of these child injuries. The study found cases or incidents that showed that parents, who slide down slides with their small children, can often be the cause of fractures to their children. As child and parent go down the slide, the child's foot or slide can get stuck on the slide. Due to the weight and force of the parent, an injury can result to the child's leg or foot that gets stuck. Retired Alabama Police Officer (Issac "Andy" Baker) Indicted for Sexual Abuse / Sodomy of Child in Day Care Center

In Tuscaloosa, Alabama, FOX News and other media outlets reported a very disturbing story, as follows: Issac "Andy" Baker served the citizens of Alabama for 25 years as a patrol officer between 1975 and 2000. Mr. Baker's wife ran an in home day care center. A young girl stated that Mr. Baker sodomized her at the in home day care center. As a result of the young girl's allegations, a grand jury recently handed down an indictment of Mr. Baker. If the allegations are true, then this case is quite distrubing. Apparently, the grand jury took the allegations seriously enough to hand down the indictment.

Of course, Mr. Baker will be entitled to a criminal defense attorney on this matter. While FOX News and others reported the indictment, details of evidence were not reported. As such, it would be interesting to know the following:

*When did the girl report the abuse?

*Is there any forensic evidence that supports the allegations?

*Were any statements made by Mr. Baker, his wife, or other potential witnesses?

*Have there been allegations in the past?

*Was a medical examination performed on the child?

*If so, what did the medical examination reveal?

*What evidence / testimony was presented to the grand jury?

This case is disturbing in that parents these days may not be able to even trust that a former officer is a safe person to be around children. Criminal background checks help screen out dangerous people with a criminal history of violence or crimes against children; however, if the dangerous person has never been caught - then the criminal background check will be clear. The bottom line is that parents can never be too careful with their children's safety. Australia: Researchers Study Driveway Deaths of Children

In the United States, children are the unfortunate injury victims of driveway accidents or incidents. Many such incidents take place when a driver unknowingly back up over a small children standing, sitting, or walking on a driveway. The height of the vehicle combined with inattention of the driver and lack of safety awareness of the child all contribute to cause these injuries. In Australia, driveway injuries / deaths are also prevalent. The Queensland University of Technology will be conducting a study to determine the cause of such incidents / accidents and safety precautions that can be taken to avoid or reduce the rate or number of such injuries and deaths. Researchers probe tragic driveway deaths of children

Researchers are hoping to shed new light on driveway deaths, which claim the lives of around a dozen young children each year across Australia.

Driveway motor accidents are one of the leading causes of death and serious injury in young children.

The Queensland University of Technology is embarking on a study, funded by Queensland Health, to reduce the incidence rate of such accidents.

Dr Kerry Armstrong, from QUT's Centre for Accident Research and Road Safety (CARRS-Q), said information was needed from parents and guardians which would help to reduce the risk of low-speed vehicle run-overs.

"CARRS-Q statistics show that Queensland has the highest per capita rate for low-speed vehicle run-overs - leading to approximately four children being killed and 81 hospital presentations each year," Dr Armstrong said.

She said the incidents most commonly involved a child under five at their own home or that of a relative, with a parent behind the wheel of the car.

Dr Armstrong said four-wheel drives and light commercial vehicles were the most commonly involved vehicle types, with four-wheel drives accounting for 41 per cent of all low-speed child driveway deaths between 1994 and 2000.

She said children in rural areas are also known to be at a higher risk, with two in three driveway fatalities occurring in non-metropolitan areas.

"Importantly, in almost all driveway run-over incidents, there was no clear separation between the driveway and the rest of the yard or play area," she said.

The research will seek information from parents on what steps they had taken to ensure children stayed safe in and out of the house and how they found out about safety measures.

The information would be used as the basis of a new safety awareness strategy.

Bullying Laws: Child Safety Advocates Argue that the Laws Are Weak and Rarely Enforced

Forty four states have bullying laws in place that deal with the real problem of bullying schools. According to a recent article in the Gainesville (Florida) Sun Newspaper, many of the bullying laws that are in place lack solid enforcement powers and / or are not enforced by the school or school district. The implementation of bullying laws is certainly progress since these laws did not exist years ago; however, there is a real problem with the lack of enforcement of these laws or more simply stated consequences to those who commit acts of bullying in schools. Many parents, with children who have been the victims of bullying, are frustrated with the system in place in various States. Since bullying laws are relatively new and many school administrators do not known how to or when to enforce the laws, many acts of bullying continue to go unpunished.

If your child has been the victim of a bully in a school system, it is important to review the applicable bullying laws and the school board procedures for dealing with a bully. In some cases, it may be helpful to get advice from a child injury lawyer or an education lawyer.

Distracted driving has been a problem since people began driving. Over the years, there have been more things to distract a driver's attention. Prior to the use of mobile phones, drivers were distracted by music, eating, talking, reading (yes reading) and other non-driving activities. With the availability and use of mobile phones and now smart phones like the Blackberry and iphone, drivers are now distracted by e mails, text messages, and internet browsing. The Gainesville (Florida) Sun Newspaper recently published an article ( States Send Mixed Messages on Texting While Driving Laws) that reviewed laws in various States regarding text messaging / mobile phone use and driving. Some States ban or restrict the use yet post traffic updates to mobile phones by text messaging / Twitter and other applications.

Whether there is a law in place or not, a person can be charged with negligence or even a crime while using a mobile phone when there is an accident. This is especially true in automobile accidents that lead to serious personal injuries or wrongful death.

Defending the Man versus Defending the Criminal Conduct - The Roman Polanski Case

The arrest of Roman Polanski recently in Switzerland has resulted in comments and opinions from famous people around the world including Whoopi Goldberg. A recent article posted at the Politics Daily website noted the comments of Ms. Goldberg and others. The author of the article, Domenica Machetti, rightly pointed out crimes were committed by Mr. Polanski that are unfairly being trivialized or excused by celebrities and other famous / powerful people. In considering this story, it appears that many people are defending Mr. Polanski since he is a famous and talented person. But really, can his actions be defended at all? It has been reported that Mr. Polanski gave drugs and alcohol to a thirteen year old girl and then proceeded to rape or have sex including anal sex (sodomy) and oral sex. If Mr. Polanski was an unknown school teacher who committed these crimes in the 1970s, would any celebrities be coming out for his defense? If there was a video tape showing Mr. Polanski raping this young girl, would Whoopi Goldberg still comment that rape is not really rape? You can praise Mr. Polanski all you want for his movies and career in the movie industry. However, do not defend a child rapist. As pointed out by Domenica Marchetti in her article, Mr. Polanski "needs to be brought back to faxe the consequences of his despicable actions."

Traumatic Brain Injury to Children and Adults - Expert Medical Advice

Children (as well as adults) suffer injuries known as traumatic brain injury every day. These injuries can range from the very mild to injuries that can cause brain damage or death. Mild traumatic brain injuries are often referred to as concussions. Symptoms or complications following a head injury can be experienced immediately while some can be delayed. It is important for coaches, teachers, caregivers, parents, and medical providers to be aware of the signs and symptoms of a serious traumatic brain injury so that medical care can be obtained as soon as possible. Dr. Beth Slomine is a specialist at the Brain Injury Rehabilitation Program - Kennedy Krieger Institute based in Baltimore, Maryland. Dr. Slomine offered advice on traumatic brain injuries which included the following:

*Use safety precautions which can help reduce the incidence of brain injuries. Safety precautions include the use of seat belts, child safety restraints, helmets during bicycle and sports play when appropriate, and the use of playgrounds with shock absorbing surfaces.

*Following a head injury, watch out for the loss of consciousness, confusion, nausea, dizziness, weakness, lethargy, visual changed, and numbness. If any of these symptoms take place, get immediate medical attention and follow up.

*Keep a close eye on symptoms that can improve over time OR get worse over time.

*Rest is important after a head injury even after evaluation at an emergency room or after a doctor's visit.

*Avoid a return to at risk activities until the symptoms completely resolve.

Grand Praire, Texas Day Care Center Reopens Following Investigation (Prior Accident Involved Day Care Van Driver With No Driver's License)

In Grand Prairie, Texas, there was a serious van accident that involved personal injuries to 13 children on the van. Offender Locator is an i Phone application that allows concerned parents and others get information about the residence of sex offenders. i Phones have GPS functions that can allow an i Phone user to search databases and information by an address or by current location. The Offender Locator is a simple but effective program in providing this valuable information to parents, caregivers and others. While no system or database is perfect or free from flaws, the information can assist parents in making safety precautions and plans when there are nearby sexual predators or offenders. Parents may want to use a program like this to search for sexual offenders / predators in the child's neighborhood, near the school, near friend's homes, near playing fields, and other areas. Supervision is important regardless of the presence or absence of sexual offenders and predators; however, information and knowledge can serve important functions for parents with the goal and mission of protecting their children. Child Consumes Cocaine at New Jersey Day Care Center

In East Orange, New Jersey, a father stashed or stored a bag of cocaine in his son's clothing. The boy went to a day care center and thought that the cocaine was candy and gave it to three other children in the day care center. Since the boy was only four years old, there is certainly no wrong doing on the part of the boy who innocently believed that the cocaine was candy or food. Typically, day care centers do not search through a child's pocket or back pack upon entry to the day care center. While this is not required, it may be a good practice to follow with the consent of the parents who enroll their children at the day care center. Children often times bring other objects into school like coins, small toys, and other items. Small children are at risk for poisoning and choking incidents. As such, all possible and practical safety measures should be utilized by the day care center as well as parents who send their children to the day care center. The father, who stored the cocaine in his son's clothes, was not only negligent. He was also guilty of a crime for doing so. Of course, the father will be entitled to a defense on these charges. Regardless of the outcome of the criminal case, this incident shows the dangers of children bringing drugs, poisons, and other items into day care centers that can harm or cause the choking of children.
