7 Month Old Died After Being Left in Vehicle in Dallas County (Red Bird) Texas

In Dallas County (Red Bird), Texas, a 7 month old (Briana Jones) was forgotten in a vehicle and died. When the child was found, she was rushed by paramedics for emergency treatment at Methodist Charlton Medical Center. It appears from the facts presented that the child died from heat exposure or heat stroke. Unfortunately, deaths of this nature continue to occur because parents, babysitters, and caregivers continue to be forgetful and leave children unattended in vehicles that get a lot hotter than most people realize. Furthermore, there are other dangers to leaving a child in a vehicle unattended.

Some experts estimate that the inside of a vehicle can reach temperatures exceeding 120 degrees when the temperature is 80 degrees outside and the vehicle is exposed to direct sunlight for an hour or so. Houston, Texas Middle School Student Stabbed Before Class

In Houston, Texas, school officials and police officers are investigating a stabbing that took place approximately 30 minutes before school started at Pershing Middle School. The weapon used was a pocket knife. News of the stabbing was quite upsetting for the students, parents, and teachers associated with this school. It is quite frightening to think that a child could, in this day in age, be stabbed by another student at school. Las Cruces, California - School Custodian Steps in to Help Boy in Car Pool Incident

In California and other States, there are some remarkable teachers and school employees who are working hard to protect the safety and welfare of children. If a person decides to work in a school system, the safety of a children should be a paramount concern for teachers, administrators, support staff, volunteers, parents, and custodians. In Las Cruces, California, Jerry Rios, a custodian employed at César E. Chávez Elementary School is credited with saving a kindergarten child (Dominic Lujan) from serious personal injuries when the child's jacket was caught in the door of a vehicle in the car pool line. Rios, who recognized the danger of the situation, jumped in front of the vehicle to make sure that it stopped. Mr. Rios was later honored for his heroism and quick thinking by the school and administrators. Schools, teachers, and other care givers should keep this story in mind when caring for children. Kansas Day Care Centers - Child Care Centers: Is A Child Care Center Permitted to Impose Corporal Punishment or Other Forms of Discipline?

Child care centers and day care centers in Kansas are regulated by the Kansas Department of Health and Environment through various laws, rules, and regulations. Pursuant to Kansas General Regulation - K.A.R. 28-132 - Child Care Practices (Pages 34 - 35), a child care center has a duty to maintain a written policy as to discipline at a child care center. A child care center is prohibited from punishment that is physically harmful to the child. Furthermore, a child care center cannot humiliate or frighten a child as part of imposing discipline at the facility. The Kansas regulations specifically prohibit corporal punishment including spanking, pulling of hair, swatting, the yanking of an arm, or similar type of punishment. Verbal threats are prohibited as are derogatory remarks. The regulations also address other prohibited actions like locking a child in a room or box, withholding food or forcing food, and stinging or burning the mouth or other parts of the child's body.

These regulations have purpose and meaning. A violation of these regulations is a violation. It does not matter that a child did not sustain permanent physical injuries or scarring. It also does not matter what the child care worker does at home or with his or her children.

Kansas facilities have a duty to follow these regulations. It is not only the law but also in the best interests of children to avoid punishment that is physically or psychologically harmful.

Desired Outcome or Goals of Child Care in Kansas

The Kansas Department of Health and Environment is the agency responsible for implementing and enforcing regulations as they pertain to child care in the State of Kansas. This can range from infants in a small home day care center to school aged children in after school programs to foster homes. The goal or desired outcome of child care is set forth in Chapter 65 - Public Health - Article 5 - Section 528 - Child Care Policy of State; Desired Outcome. This law sets forth the mission of child care that in in place to guide the state agency and its staff in supervising child care and day care centers in Kansas. In particular, the goal or desired outcome of child care is to provide parents and caregivers with high quality and affordable child care. The child care should be stable, diverse, and efficient among other things. Parental involvement is key. Parents should take an active role in inspecting a child care center and staying involved with the school or center on a daily basis. Augusta, Georgia - Police Report that Child Was Left at Park - Child Helped by Good Samaritan

In Georgia and other States, day care center and child care center providers have a duty to supervise children enrolled in the program. If there is a field trip or off site activity, it is important for day care center operators to make sure that all children are supervised at the activity and that all children are properly transported or brought back to the facility. In many instances, a simple checklist or attendance sheet can be be used to make sure each and every child is present and accounted for. In some instances, children are lost or forgotten about because there is no checklist in place or because the checklist is not used. Leaving a child behind can lead to a variety of problems and dangers for a small child. In Augusta, Georgia, a 2 year old child under the care of Amandable’s Angel’s Childcare Center, her 2 year old daughter Mackenzie, Turns out he did know something. Investigators say when the daycare workers left behind at a park. When the day care center first became aware that the child was missing, the staff did not know where she was. It took the help of the child's 4 year old brother to let everyone know that the missing child may have been left behind at Elliot Park. The child was later found, but that is not the end of the story. The three day care workers involved were charged with the crime of deprivation of a minor. Of course, the day care workers will have the right to defend themselves in the criminal proceedings. Regardless of the outcome of the criminal case, day care centers should take stories like this heart and use a checklist consistently so that each and every child is accounted for and that NO CHILD IS LEFT BEHIND. Brooklyn, New York 3 Year Old Attacked by Family Pit Bull

In Broomfield, Colorado, a teacher is accused of sending inappropriate text to students. There cases are interesting in that there is typically electronic evidence that can identify the sender and the receiver of these text messages. The messages themselves are evidence that can show criminal acts and intent on the part of the sender. Of course, the teacher will be entitled to defend himself through the services of a public defender or a private criminal defense lawyer. How many messages were sent by the teacher to students?

Can the messages be subject to one or more meaning or interpretation?

Day Care Punishment - Withhold Lunch or Meals Violates Pennsylvania State Guidelines - Two Day Care Workers Fired

In Pennsylvania and other States, day care workers cannot withhold food or meals to children as a means of punishment or discipline. At the Middle Bucks Institute of Technology, two teachers were terminated from their day care positions at the day care center for withhold food or meals from a toddler. It was reported that the workers withheld the food because the toddler refused to clean up as instructed. The day care center reported this incident to the Pennsylvania Department of Welfare. It is important for day care and child care workers to follow the laws, procedures, and guidelines set forth by Pennsylvania law. Teen Mother Arrested for Not Placing Child in Safety Seat / Safety Belt - Automobile Accident in San Antonio, Texas

In San Antonio, Texas, a teen mother has been arrested regarding an automobile accident that led to injuries to a toddler. Police reported that the mother did not properly buckle her infant son in a car seat. Unfortunately, there was an automobile accident in which the child bumped his head on the dashboard and was knocked unconscious. Bicycle Helmets - Important Safety Measure for Children Riding Bicycles

In Arkansas and other States, emergency room doctors and pediatricians see their fair share of child injuries from bicycle accidents. According to Mechelle Winslow of the Arkansas Children's Hospital Injury Prevention Center, bicycle helmets are an important safety measure for children riding bicycles. Head injuries to children are common in bicycle accidents. With a proper helmet, many injuries can be prevented or lessened with the helmet taking the brunt of the trauma rather than the child's head. A good suggestion by Winslow is to have the child pick out his or her own helmet. This may make it more likely for the child to wear the helmet. One of the sure signs of spring is children let loose in the playground. After a long winter, children are naturally thrilled to be out in the warm and sunny weather and ready for some fun. That's especially true for children aged five to nine who are active and imaginative, and learning new skills every day.

At this age, children like to push their physical boundaries and really enjoy jumping, climbing and balancing. They also think that they can do more than they are able to do and often take chances that can result in an injury.
Fall-related injuries are the number one reason for children aged five to nine years to be treated at hospital emergency departments. They are also the second leading cause of brain injuries for children. These injuries involve playground equipment more than any other type of fall.

While the actions of children can be unpredictable, injuries do not have to be. There are some simple ways that parents and caregivers can reduce the risk of injuries in this age group.

Start by making sure that the places children play are safe. Before children start to play, check the playground equipment for any damage, including loose bars, broken swing chains and nails or bolts that protrude. Make sure the hand rails are secure and free from splinters. Deep, soft surfaces such as sand, pea gravel and wood or rubber chips will cushion falls and prevent many injuries. Don't forget that injuries can also happen on backyard equipment, so do a safety check of your own home playground areas.

Young children can be injured on playgrounds designed for older children. If a child is too small to reach and use equipment alone, it is not designed for that age. Make sure that the equipment is the correct size and meets the physical abilities of your child.

Supervision of children decreases the chance of injury, so watch children closely. Stand next to all children when they are learning a new skill or climbing. Reduce a child's chance of choking on play equipment by avoiding clothing with drawstrings or scarves and removing bike helmets before playing on the equipment. Do not taking skipping ropes onto playground structures.

Teach children the playground safety rules. Children should know to wait and take their turn, to avoid pushing and to slide down feet first and walk up the steps or ladders, rather than running up the slide. Make sure you are consistent with the rules and that children follow them every time. Praise your children for playing safely and role model by following the safety rules yourself.

Playgrounds can be a great source of exercise, a time to meet other children and be involved in creative play. Ohio Day Care Center Investigated for Alleged Personal Injuries to Child

In Monroe, Ohio, there was an investigation into alleged burns to a child from an Ohio Day Care Center. The initial news reports indicated that a child may have suffered burn type injuries from a Mr. Magic Eraser cleaning product that may have been used on a child's body at the day care center. Channel 9 WCPO news subsequently reported that investigators determined that the child was not burned at the day care center. The day care center at the center of this controversy was Mount Pleasant Children's Village. It was reported that the alleged injuries were not burn injuries but a skin condition / problem caused by rubbing. It appears that no criminal charges will be followed on this matter. Child injuries need to be investigated to determine the cause of the injury and whether the injuries were preventable with proper supervision and care at the day care center, home, or elsewhere. Some child injuries are accidental in nature and really could not be foreseen or prevented while others could easily be prevented with due diligence and common sense.

Study Finds Problems in the Quality of Georgia Day Care Centers

Ohio Booster Seat Law Goes Into Full Enforcement - Applies to Children Ages 4 to 8 Years Old

Children from the ages of 4 to 8 years old must be placed in a booster seat unless the child is 4 Feet 9 Inches tall. Children from the ages of 8 to 15 years of age must wear a seat belt. Safety advocates are pleased with the passage and enforcement of this law. 10 Year Old Boy Tasered by Police at Tender Teddies Day Care Center in Martinsville, Indiana

It was reported by Fox News that one police officer slapped the child and another tasered the child for 1 to 2 seconds. The child's guardian operates the day care center. Children enrolled in a day care center have a right to be cared for in a safe and clean environment. Day care workers should dutifully supervise the children and make sure that the children safe and kept away from dangers and hazards. Some day care workers and centers take short cuts in care and take actions that are harmful to children. Some day care workers even drug children to make them tired and easier to care for. In Spain, one such day care worker was caught and is being charged with a crime after many children were hospitalized. Laboratory test showed that the children were given or ingested benzodiazepines which is a drug prescribed by doctors to patients with anxiety, sleep disorders and panic disorders. Beaver Township, Ohio - Toddlers Fall from Second Story Window at Day Care Center

In Ohio and other States, there are many potential dangers at day care centers. Because children have poor safety awareness, it is important for day care providers to safeguard the day care center to the best of their abilities. Windows are locations at day care centers that may be dangerous. Children, from time to time, will try to crawl in the window area and in some instances out of the window area. In Beaver Township, Ohio, two toddlers at a Mennonite day care center were peering out of the window, pushed out the screen covering, and then fell seven feet to the pavement. It was reported that one of the children may have suffered a concussion.

If a home or day care center has a window open with screens in place with small children nearby, then the window and screen area should be checked to make sure that an incident like the one reported does not happen. Check with the building maintenance supervisor, contractor, or other safety expert to determine how to best safeguard the window area from curious children. Montgomery County, Maryland - Former Teacher and Field Hockey Coach Sentenced to 5 Years for Child Pornography

In Montgomery County, Maryland, a former elementary school teacher and field hockey coach was sentenced to 5 years in prison. John Joseph Kovach served as an assistant field hockey coach at Towson University and a teacher at a private elementary school located in Montgomery County, Maryland. How did the teacher - coach and mentor to children get caught? Well, according to the news reports, Mr. Kovach went online and engaged in a sexually explicit chat with a girl who he thought was 13 years old. Following investigation including a warrant for his computer was conducted. Investigators found 252 photographic images and nine videos showing child pornography. The evidence seemed to be quite strong against Mr. Kovach. It is amazing that people go online and think they are invisible and cannot be caught. It is very disturbing to know that teachers, coaches, and mentors are trolling the internet looking for their next victim. Nebraska 11 Year Old Boy (Drew Fiala) Dies Playing Choking Game

In David City, Nebraska, a family and community are mourning the loss of an 11 year old boy who died playing a game that is played by children. It is no ordinary game as it can be deadly or cause serious injuries including brain injuries. The "Choking Game" or "Fainting Game" involves the use of a belt or other item for strangulation or a form of hyperventilation. Whatever the mechanism - the goal of the "game" is to get a type of high from cerebral hypoxia which means an oxygen deprivation of the brain. 13 Year Old Teen Charged with Setting Clayton, North Carolina

In Clayton, North Carolina, police have charged a 13 year old child with setting fire to a day care center that was under construction. ABC Eyewitness News reported this story. For some reason, the teen allegedly left his home and entered the day care center to set the fire. It was not reported what lead police to this teen or what forensic evidence exist on this matter.

Whatever the cause of the fire, it is a shame that a day care center will have to delay its opening due to this fire. Day care centers, that follow regulations and staff their centers appropriately, provide parents with needed help so that parents can work their jobs and manage their schedules. Day care centers can also be instrumental in educating our children prior to the start of their elementary school years.

*Have a frank and honest talk with your child about the dangers of drinking and driving; and

Girl Crossing Street Hit by Car in Greendale Village Hall, Wisconsin

In Greendale Village Hall, Wisconsin, a 5 year old was struck by a vehicle as she was crossing the street. At the time of the incident, the girl was walking with her brother, Aunt, and Mother. Fire Rescue responded to the scene and the child was taken to Children's Hospital of Wisconsin. Unfortunately, despite the efforts of Fire Rescue and hospital personnel, the girl died as a result of this automobile / pedestrian accident. It was reported that the driver was stopped a stop sign and then proceeded to make a turn as the girl and others were walking in the designated crosswalk. It is tragic that a girl who was a leisurely walk with her family was hit by a vehicle and lost her life. Children are the unfortunate victims of accidents as pedestrians and / or bicycle riders. Montgomery, Alabama Child Abduction Attempt Failed at Hunter Missionary Baptist Church

Washington Child Expected to Survive Despite Being Subjected to Horrible Child Abuse

A Spokane Washington child is expected to survive according to authorities despite being subjected to horrible child abuse and neglect. It was previously reported that doctors did not expect this child to survive. Some how, this child found the strength to hold on despite being a victim of flagrant child abuse at the hands of her father according to allegations made by police / prosecutors. Skyelynn Jamison is being treated at Sacred Heart Medical Center. According to Spokane Police, hospital officials are reporting that her condition is improving and she is expecting to survive. While she is surviving, it appears that she has suffered permanent life long injuries. She is on ventilator and is brain dead or has severe brain damage according to court documents. How did this child suffer such horrific injuries? According to the story posted at KREM.COM, her father allegedly choke and smother her when she cried. In Washington State, a parent needs to take a test to get a driver's license but does not need to take a test or even take a class to be a parent. Unfortunately and tragically for this child, she was the subject of severe and brutal child abuse just for crying and being a typically baby.

A Craigslist Ad - "Boy for Sale" has sparked a criminal investigation. The Craigslist Ad was posted for Spokane, Washington. The Spokane County Sheriff's Office is investigating this matter. It is a crime to try to buy or sell a child. The Ad was eventually removed from Craigslist. Children are not pets or possessions to be bought, sold, or traded over the Internet or anywhere else. Illegal ads and acts are often posted on sites like Craigslist and Ebay because there is a limit to the screening process of these sites. The millions of items and services listed every day make it difficult to perfectly screen out disturbing ads like this one. Fulton County, Georgia - Man Pleads Guilty to Pimping Out Teenagers for Sex

In Fulton County, Georgia, a man pleaded guilty to charges that he pimped out two teenage girls for sex. Jonathan Terry, age 27, was accused of pimping and raping a 14 year old girl from Sandy Springs, Georgia. The Judge sentenced Mr. Terry to 20 years of prison. Mr. Terry will now be registered as a sex offender. The victims reported Mr. Terry's criminal acts to the police in May 2009.

Brooklyn, New York - School Bus Driver Accused of Leaving 2 Year Old Alone and Unsupervised on Bus

Texas Man Arrested for Allegedly Causing Burns to 2 Year Old Girl

In Texas, a man was arrested for causing serious personal injuries to a child while he was babysitting the child. Brandon Deon Stewart, age 25, was arrested on criminal charges that he abused a 2 year old girl under his care. Police reported that there were severe liquid burns on the girl on her legs and genital area. There were no details as to how the incident took place or the liquids involved. He may try to explain that it was an accident or that the injuries were caused by another person. He will entitled to the services of a private criminal defense attorney or a public defender.

Parents, child care providers, babysitters, teachers, and others should never use physical force or torture as a means of punishment. This kind of child care is barbaric and absolutely amounts to cruel and unusual punishment. Child should be taught right from wrong. Burning a child to prove or make a point is never acceptable.

East Bridgewater, Massachusetts Shows the Dangers of Facebook

In East Bridgeater, Massachusetts, homeowners are assessing the damages after a party left their home and possessions in partial ruin after a teenage party went bad and violent. While the homeowners were out of town, the homeowners' 18 year old son was encouraged to have a party. Once word of the party spread through Facebook, the party swelled in numbers and destruction. Doors were kicked in, furniture was ruined, and people (for whatever reason) urinated in all parts of the house. A police investigation ensued and arrests were made.

While parties of this nature certainly existed prior to the age of the Internet and Facebook, it seems that Facebook and Social Media sometimes aggravate an already bad situation. It is uncertain how many people learned of the party and the out of town parents through Facebook and Social Media.

This case and incident should be a good teaching tool for parents, children, and any others using Facebook. There are all kinds of people on Facebook. Mother Arrested Arrested After Automobile Accident in Oklahoma City, Oklahoma - DUI Charges and Child Endangerment Charges - Mother Was Transporting Children from a Day Care Center

In Oklahoma City, Oklahoma, a mother has been charged with DUI (Driving Under the Influence) and Child Endangerment regarding an automobile accident. Slettie Yvonne Heard, age 25, was transporting 6 children in her vehicle at the time of the Oklahoma automobile accident. According to a news story reported by Eyewitness News 5, Ms. Heard backed into a parked truck as she was transporting children after they were picked up from a day care center. Ohio School Bus Driver / Mother Suspected of Burning Her Child with a Spoon

In Ohio and other States, detectives with a SVU (Special Victims Unit) investigated and arrested a mother and Dayton (Ohio) Public School bus driver on criminal charges of child endangerment. The criminal charges involve allegations that the mother (Kristal Hill - age 33) burned her 4 year old daughter with a spoon that had been heated from a stove. Ms. Hill will be entitled to a criminal defense attorney from the public defender's office or a private law firm. The 4 year old girl had told different stories of the incident and this may be part of a possible defense of the case by the mother and her attorney.

Parents have some rights in the manner in which they discipline and raise a child; however, there are limits to said parental rights. When the discipline or corporal punishment is excessive, criminal investigations and prosecutions result. What is excessive? The answer to this question may depend on who you ask. Most States have laws in place that define excessive punishment and / or child abuse. Connecticut Catholic Bishops Opposed to Sex Abuse Act - Change to Statute of Limitations

In Connecticut, a bill is being proposed that would effectively change the statute of limitations for sex abuse cases in the State of Connecticut. Currently, the statute of limitations in Connecticut for sex abuse cases is 30 years past the 18th birthday of the sex abuse victim. The proposed Connecticut law would allow someone older than 48 years old to pursue a case as long as it was pursued in conjunction with the claim of a younger person. The Catholic Church is publicly opposed to the change in law as it would expose the church to additional claims and liabilities that would otherwise be stale under the current Connecticut law. One of the buzzwords used by church officials is the term frivolous lawsuits. The church has for years hidden sexual predators and child molesters behind its doors. To state that the claim of a 50 year old is frivolous ignores the years of injustice and abuse that was ignored and even hidden by the church. Judges and juries should be able to the weigh the facts of each year. The determining factor should not be the age of the victim pursuing the case but the facts, evidence, and testimony behind the claims of abuse, neglect, and child molestation. Well, it appears that the man posted a video of the heinous crimes on the Internet and thereafter another man reported him to the authorities. Brian Beston, age 36, pleaded guilty to the cirmes of sexual exploitation, child rape, and dealing in child pornography.
Prosecutors will recommend a minimum 26-year sentence when he is sentenced May 14 in King County Superior Court. He could also face life in prison. Naperville, Illinois Man Sentenced to 13 Years in Prison for Sexual Molestation Acts at a Day Care Center

In Naperville, Illinois, Jose Luviano was sentenced to 13 years in prison for molesting children in a day care center operated by his wife. It is most disturbing that children were abused and neglected a the very place, a day care center, that the children were supposed to receive care, education, and proper supervision. Mr. Luviano admitted to the allegations and a plea deal was reached with prosecutors regarding the criminal sexual molestation charges.

Prom Dress Controversy in Alabama - Punishment - Paddling or Suspension

Suspicious Bruises Leads to Arrest of Day Care Owner / Operator

Police and the State Department of Children and Families are involved in a case regarding the "Home Away from Home Daycare Center" based in North Branford, Connecticut. The owner / operator - Laura Pearson was charged with risk of injury to a minor and for assault. The criminal allegations center around a 23 month old girl who was observed with bruises on her left cheek and her right cheek. A doctor at the Yale - New Haven Hospital opined that the bruises were most likely caused by an adult who squeezed the cheeks. Ms. Pearson denies that she harmed the child. A most disturbing news story was reported out of Saginaw, Michigan. It was reported that a care giver of a 10 year old girl traded the girl to man for cocaine. Thereafter, the man sexually assaulted the 10 year old girl. The woman (Angela Blackwell) was arrested and the man (Johnnie L. Griffin) is being sought by police. Both face felony charges. Oklahoma City, Oklahoma Day Care Center Cited for Sex Concerns Among Children - Importance of Proper Day Care Supervision

In Oklahoma City, Oklahoma, a day care center that part of a national chain of cay care centers (La Petite Academy) has been cited by the Oklahoma Department of Human Services (DHS) for a lack of supervision of the children. 3 Year Old Child Assaulted at Day Care Center in Manheim, Pennsylvania

In Manheim, Pennsylvania, a day care worker has been criminally charged with assault and endangering the welfare of a child regarding an incident that took place at the day care center - Small Freys Children Center. A 3 year old girl was placed in a time out. During the time out session, the child kept on turning her head. A day care center worker was not pleased with this conduct and "slammed" the girl's head against the wall. While placing a child in a brief time out period can be appropriate, slamming the girl's head against a wall is never appropriate. In fact, police in Pennsylvania have deemed this to be criminal conduct. The incident was witnessed by another day care worker.

When child abuse or neglect is witnessed or suspected at Pennsylvania day care center, the witness or person with knowledge of the abuse / neglect has a duty to report the incident to state officials. The child in this case was later treated at a hospital for a closed head injury.

The day care worker, Julie E. Iddings, age 26, will have the right to defend herself through the services of a Pennsylvania criminal attorney for such charges. The evidence against her will consist of the medical records, photographs of the injury, statements made by Ms. Iddings (if any), and the testimony of the witness to the incident. Slidell, Louisiana Man Arrested Man for Death of 22 Month Old Girl

In Slidell, Louisiana, a man was arrested and charged with the death of a 22 month old girl. As reported in the WWLTV News, the St. Tammany Sheriff's office believes that Rubie Boland was shaken and assaulted by her babysitter at the time - Andrew Roberts (age 20).

The grandmother called an ambulance to get some medical assistance for the child. She was then rushed to a local hospital but the doctors were unable to save her life from the alleged attack that caused this life ending personal injuries to this small child.

St. Tammany Sheriff Strain reported that Mr. Roberts was already having a "bad day" prior to the incident. Rubie Boland had a potty accident which is common for children of this age. Apparently, Mr. Roberts responded harshly to this incident by
picking Rubie up by her feet and slamming her against the floor.

The assault and truly excessive discipline alleged to have been committed by Mr. Roberts causes serious personal injuries and traumatic brain damages to this helpless and defenseless child.

Lakeville, Minnesota 11 Year Old in Hospital with Serious Head Injury Following Bicycle Accident

In Lakeville, Minnesota, an 11 year old was admitted to a Hennepin County Medical Center for severe head injuries following a Minnesota bicycle accident. The accident was reported by the Pioneer Press. The child was struck by a vehicle during the evening hours. He was not wearing a helmet. The story posted did not contain many details of this Minnesota bicycle accident.

Children should always wear a helmet when riding a bicycle. Helmets can and do help prevent head injuries or help reduce the severity of a head injury. Parents should get children into a habit of wearing helmets at all times - there should be no exception to this rule. A serious personal injury on a bicycle can take place at home in the driveway, on the sidewalk near the home, and on the street near the home. Whether your child is heading out on a short ride or a long ride - a helmet should be worn.

Drivers have a duty to be on the lookout for bicyclists and pedestrians. It is no excuse to negligently hit a bicycle rider just because the bicycle rider is not wearing a helmet. Drive slowly and carefully any time children are on or near the roadway.

Edmond, Oklahoma - Loaded Guns Found in Day Care Center

In Edmond, Oklahoma, police reported that a home based day care center Royal Platinum Care had loaded guns on the property. Loaded guns were found in the attic, garage and a safe. There were no reports that the children had touched or otherwise accessed the guns; however, the State of Oklahoma Department of Human Services investigators believed that the guns violated Oklahoma laws as they pertained to day care centers. Alabama 8 Year Old Elementary School Student Struck and Killed by School Bus: Did Bus Driver Follow Proper Procedures Set Forth in the Alabama Commercial Driver License Manual?

In Florala, Alabama, an 8 year old elementary school student was killed when she was hit by her own school bus. The child exited the bus and then walked in front of the bus. According to Florala Police Chief Sonny Bedsole, it appeared that the school bus driver did not observe that the child got off the bus because the child may have exited off at the wrong stop or the wrong time. School bus drivers in Alabama are required to have an Alabama Commercial Driver License. The Alabama Commercial Driver License Manual has a special section that covers School Bus Drivers and Proper Driving. As stated in this manual at Chapter 10, Section 10.2 - Loading and Unloading, more students die while getting off or on a bus each year as compared with those that are killed in the school bus. The manual points out that it is vital that school bus drivers what how to drive and respond to situations before, during and after loading or unloading students on a school bus.

Pursuant to the Alabama Commercial Driver License Manual, there is a specific section on Unloading Procedures on the Route located at Chapter 10, Section 10.2.3. This section states that school bus drivers shall have the students remain seated until told to exit. Then, the school bus driver should check all mirrors. The school bus driver is also required to count the number of students while unloading to confirm the location of all students before leaving the location. It would appear that this section may apply to the facts of this case. The school bus driver should have made sure that all students were seated before they got up to exit. If the 8 year old student got off at the wrong exit or at the wrong time, this may not be relevant if this section applies to the facts of this case.

It could be argued that the school bus driver should have been aware of the students who exited the bus as well as the students who remained on the bus. Pursuant to Chapter 10, Section 10.2.3, a school bus driver must account for students outside of the bus. If a school bus driver cannot account for a student outside of the bus, the school bus driver, per the manual, is instructed to check around and underneath the bus before proceeding further in the route.

A full investigation will be conducted by the Florala Police, the school district, and / or other entities to determine the details of this tragic death and what measures could have been taken to prevent this death and / or other incidents of a similar nature from occurring in the future.

Dangers of Toys - Choking Hazards - Fisher Price "Little People"

Toys can provide a child with hours of fun play time. Toys can also present a choking or health hazard for children. Fisher Price is a major toy manufacturer and distributed. "Little People" has been a big success for the toy company for many years. Health Canada is advising parents to go through toy rooms and boxes to see if any pre-1991 "Little People" are located. The toys pre-1991 were and are small enough to create a serious choking hazard for small children. The post 1991 "Little People" have a wider base and certainly would be more difficult to impossible for a child to swallow.

Trenton, New Jersey - Criminal Charges Filed Against Day Care Workers for Leaving 2 Year Old (Ty'on Moore) in Van for 5 Hours

In Trenton, New Jersey, criminal charges were filed against the driver of the transport van employed with Roselle-based On Time Transport Inc. and a day care center worker employed with Pediatric Day Health Center. The incident was very problematic in that the child had serious health conditions that put the child at significant risk for serious personal injuries. The child, Ty'on Moore, was enrolled as a student at the Pediatric Day Health Center. Ty'on was left in a van in front of the day care center for about 5 hours. Ty'on has medical problems including chronic asthma and seizures. The family was very relieved, after Ty'on was evaluated and treated at a local hospital, that more serious complications did not result from such neglect. Police reported that Ty'on was visibly dazed as a result of the incident and possible medical complications from the 5 hour stay in the van.

Negligent cases involving a child left on a day care van, bus, or other vehicle continue to be reported. These cases are especially problematic and even fatal during hot spring and summer months. Day care centers should have a written policy and procedure in place that should be closely followed so that no child is left behind or forgotten on a day care center vehicle. Pedestrian (Jose Chavez - Age 18) Hit by Charter Bus of Middle School Students

Houston, Texas Man Charged with Wrongful Death of 3 Month Old Baby (Kamron Kelly)

In Houston, Texas, a family is grieving the death of 3 month old Kamron Kelly. Police believe that the mother's boyfriend (Nathaniel Flowers) shook the baby which in turn caused injuries consistent with Shaken Baby Syndrome. A neighbor had attempted to revive the baby after he was contacted by Nathaniel Flowers. During the CPR efforts, it was reported that Flowers attempted to leave the area or scene. The baby died two days after the incident after being in critical care at Texas Children's Hospital.

Former Girl Scouts Volunteer Pleads Guilty to Producing Child Pornography Video

Butler County Sheriff's Office (Ohio) Identify Girl Hit by School Bus

The Butler County Sheriff's Office released the name of the 15 year old girl who was recently hit by a school bus. Her name is Sodany Phann. It was reported that this West Chester, Ohio accident involved a bus with the Petermann Bus Company. It was dark and raining when the accident took place. Since the accident involved a death, there will be a full investigation into the facts and circumstances of the accident. Arrests Made in Rape Case of 7 Year Old in Trenton, New Jersey

In Trenton, New Jersey, police arrested three juveniles and two adults who allegedly participated in a gang rape of a 7 year old. According to a story posted by the Associated Press, the 7 year old girl's stepsister (age 15) brought the girl to a party and sold the girls to others according to police and investigators. This is a most disturbing story which shows the poor judgment and callousness of teenagers and adults alike. Children should be protected by family members, friends, day care providers, and others. Children should not be taken to parties to be abused, molested, or raped. Hopefully, justice will prevail and the adults and juveniles who committed this crime will serve an appropriate prison term for their crimes. West Virginia Passes Tough School Bus Safety Law

In 2007, six year old Haven Brooke McCarthy was getting out of her Lincoln County, West Virginia school bus when she was hit and killed by a vehicle illegally passing her school bus. At the time, the driver’s offense was considered a misdemeanor. Since Haven’s death, her family has been working with lawmakers to toughen up the penalties for breaking school bus safety laws.

Thanks to their efforts, the West Virginia legislature has passed a tough new law that is aimed at avoiding or preventing child injuries when kids are on their way to and from school. Under the newly passed law, drivers in either direction who fail to stop when a school bus stops and flashes its warning lights may face felony charges and even prison time for the offense if someone is injured or killed due to their actions. A driver who causes an injury could face up to three years in prison; a driver who kills someone could be put in prison for up to ten years.

The law also increases fines for drivers who violate the school bus safety laws, and introduces the potential for a driver to lose his or her license - even if no one is injured. Drivers will have an extra incentive to use caution even when there is no police car in sight; the new law also allows counties to set up cameras on school buses to catch offenders on film.

Product Recall: Custom Roman Blinds from Ethan Allen Design Centers

The United States Consumer Product Safety Commission has issued a warning and recall notice for roman shades sold by Ethan Allen Design Centers under the Ethan Allen brand name. The recall involves over 150,000 shades, which are said to pose a strangulation threat if a child places his or her neck between the inner cord and the fabric back of the shade, or if the child wraps the inner cord or exposed loop around his or her neck.

The recall is for all styles and sizes of roman shades, which were custom, made-to-order shades priced between four hundred and a thousand dollars. The shades were made in a wide variety of colors, sizes and fabrics, and bear no markings indicating that they are Ethan Allen brand shades. Affected shades were sold at the stores from 1999 through December 2009.

Parents who have installed these shades in their homes should remove the shades from use immediately and contact the store where the shades were purchased to request a free repair kit. Many children have become entangled in the chords, and three children have been killed.

The United States Consumer Product Safety Commission would like to remind all consumers to carefully inspect any shades in their home to be sure that there are no exposed cords or inner cords. If such cords are found and children are likely to be present in the home, the shades should be replaced immediately.

Little Rock, Arkansas - Boy Falls Out of School Bus Emergency Door

In Little Rock, Arkansas, a tragic incident took place on a school bus. It was reported that an 8 year old boy (Malik Lewis) boarded the bus and then opened the emergency door and fell out. He suffered a fatal head injury after hitting his head on the pavement. At the time of the incident, Malik was calling for his mother as he was opening the Emergency Door. It is expected that an investigation will be conducted into this incident which will include an interview of the driver, mother, and other eyewitnesses. The story reported did not indicate one way or the other if there was a video on board the school bus which would provide additional information as to this incident.

Minivan Crashes into Day Care Center - Stamford, Connecticut

In Connecticut and other states, parents take their children to day care centers with the expectation that their children will be safe. Unfortunately, incidents and accidents happen in day care centers in Connecticut that cause personal injuries to children or put them at risk. In Stamford, Connecticut, it was reported that the driver of a minivan mistakenly crashed her vehicle into the day care center. Apparently, she mistook the gas / acceleration pedal for the brake at the time of the incident. Fortunately, there were no personal injuries reported from this incident. This is not an isolated event as there have been other incidents or reports of vehicles crashing into day care centers as a result of negligent driving or the negligent driver of another vehicle.

Automobile accidents pose a danger to adults and children. Automobile accidents even pose a danger to children playing inside a day care center. Drive safe especially near schools, day care center, and anywhere else children congregate or play.

Caregiver Accused of Injuring Nine Month Old Child with “Aggressive Play”

Matthew Wayne Lightbody of Brick New Jersey, was caring for a nine month old girl in his home when the girl went into convulsions. Lightbody called 911 right away, but when emergency responders arrived they found the girl unresponsive and bruised all over her body.

Lightbody told police that has was simply playing with the child when the injuries occurred, but according to the police report, the child appears to have been kicked and hit while Lightbody was “playing aggressively” with her.

The girl was taken to Jersey Shore University Medical Center in Neptune, New Jersey. She is listed in critical condition.

Lightbody has been charged with second-degree counts of endangering the welfare of a child and aggravated assault. He was also arrested on several other outstanding warrants and is being held in the Ocean County Jail on $100,000 bail.

The girl was not named and there was no mention in the report of who her parents are, or where they were when the injuries occurred. Parents need to thoroughly check into the competency of anyone they entrust with the care of their child. Unqualified caregivers are subject to becoming frustrated easily and striking out at an innocent child with inappropriate force. While a person charged with a crime deserves his or her day in court, a person with several outstanding arrest warrants does not seem like a good candidate for a baby sitter.

Hoover, Alabama - 15 Year Old Dies After Fall Out of Golf Cart

In Alabama and other states, adults and children ride in golf carts every day. Due to the speed and size of golf carts, many do not realize that serious personal injuries and even death can result from a fall out of a golf car or a golf cart accident. In Hoover, Alabama, a 15 year old boy (Thomas Scott Messina) died as a result of injuries that he suffered after he fell out of a golf cart. Thomas was treated at Children's Hospital but the doctors and medical staff were unable to save him from the serious personal injuries. Dangers of Everyday Household Items to Children - Holtville New York Toddler Dies After Getting Tangled in Window Blind Chain

In New York and other states, there are many dangers in the home. Toddlers are very curious and adventurous. In addition, toddlers have poor safety awareness. Many parents, day care operators, and child care providers do not realize it but there are dangers in common every day household objects like window blind cords and chains. In Holtsville, New York, it was recently reported that a 2 year old toddler died after becoming entangled in a window blind chain according to the local police. Brendon McCarthy died after what appears to be a tragic accident in his home. He was found in the home by his father. The death of Brendon is a great loss for his family, friends, neighbors and the community. Automobile Crashes Into Rockwood, Tennessee Day Care Center

In Tennessee and other States, parents send their children to day care in hopes that the children are supervised in a safe and secure educational environment. Unfortunately, unexpected accidents and dangers happen. There have been many reported cases across the United States of vehicles crashing into day care centers. Of course, no parent ever expects this to happen; however, many day care centers are located off of busy streets and highways. As such, incidents like the one recently reported in Rockwood, Tennessee do happen. Fortunately, there were no reported injuries as a result of this crash into the Michael Dunn Day Care Center. A driver of a Ford Focus lost control of the vehicle, crossed over the median, through a parking lot, and then went into a ditch and then airborne over a fence and finally crashed into the side of the day care center.
