Day-Care-Center-School-Transporation-300x207A child may be injured while being transported by a day care center, school, summer camp, after school program, or some other activity.  When a child is injured, there may be a right to compensation to the child for medical bills, pain, suffering, mental anguish, and loss of enjoyment of life.  The legal rights of the child will depend on the particular facts and circumstances of the crash, the extent and severity of the personal injuries, and type and amount of liability or automobile insurance coverage.  Whether the accident or crash is the fault of the day care center driver, another driver, or both on a comparative fault basis, there may be a right to seek damages on behalf of the injured child.

When a child is injured in an automobile accident or day care center van accident, it is important for the child to get appropriate medical care from one or more of the following medical providers:  emergency room, pediatrician, neurologist, orthopedist, physical therapist, and /or other medical providers.  The costs of the medical care may be covered by the automobile insurance of the day care center, the parents, the other driver, and / or health insurance.  It depends on who was at fault for the crash and what insurance coverage was in place for the vehicles / drivers involved in the accident.

Child Care Note Or Message As Reminder For Kids Daycare
In North Carolina and other states, parents rely upon babysitters to provide supervision and care for children while the parents are at work or otherwise running errands for the family.  Most babysitters are caring individuals who put the necessary time and effort into properly caring for the child; however, there are some babysitters out there who lack the patience, skill, and common sense to safely care for children.   Some of these absolutely careless and reckless babysitters are very young and some are very old. There are bad babysitters of all ages out there.  It is amazing that babysitters still think that it is acceptable to beat, spank, or shake a child even an infant when the child is crying or acting up.

School Bus - Summer Heat - Personal InjuryIn North Carolina and other states, day care centers are subject to various rules and regulations.  Most day care laws are governed by state statute. There are some local ordinances as well.  When rules and regulations are violated, children are put at risk for personal injury and even death.   One simple rule, that for one reason or another, continues to be violated by day care centers involves the use and documentation of list as each child departs day care regulations.   That’s right, this simple regulation only requires pen, paper, due diligence, common sense, and last but not least attentiveness. When this regulation is violated, a child can be left behind and put at great risk for personal injury.  This is especially true during hot summer months and cold witness months.  In addition, any time that a child is left behind on a day care center school or bus, a child may be injured by other means like strangulation, poisoning, choking, etc. . .

The level of risk depends on the age and physical development of the child. In the day care center, a child can choke on a food object or an everyday object like a coin, part of a toy, and other objects. Because of the real risk of choking, it is important for a day care center and its staff to maintain a safe environment that is free from hazards including those relating to choking.

The little girl was simply playing outside in her front yard on a Sunday afternoon when a vehicle when out of control and hit young Nadia in the front yard. Education%20Day%20Care%20Building%20Block%20G.jpgIn Kannapolis, North Carolina, it was reported that a day care worker was caught on video surveillance tape at the day care center mistreating children under her care. Police have charged the woman (Whitney Belk) with five counts of criminal assault for her actions. The day care center, Kids Korner Child Development Center, had video surveillance in place. The administrator (Danielle Mauldin) of the North Carolina child care center viewed videotape and then terminated Ms. Belk as an employee. The use of video surveillance can be used as evidence in criminal case. More day care centers should consider installing and utilizing videotape surveillance as a safety precaution and measure for children. Videotape surveillance can answer questions and settle disputes when there is a question as to how a child was injured or how a child was handled or treated by a teacher, assistant, and / or other staff member at the day care center. Unfortunately, staff members and employees at day care centers in North Carolina and other States continue to abuse and neglect children at a location that should be a safe haven for children. pool%20with%20gate.jpgA little girl, believed to be about 3-years-old from Charlotte, North Carolina, is clinging on to life after falling into her family’s in-ground pool. The child was playing with her parents outside in the family’s backyard when in a moment’s time the parents discovered their child was gone. After searching the nearby area, the child’s father found her in the pool, which was almost drained and had only a few feet of water in the pool. The parents performed CPR on the child until rescue units arrived. Once the paramedics arrived they performed CPR on the child until arriving at the hospital. Doctors at the emergency rooms reported they did discover vital signs.

inside%20car.jpgJudy Alvis Harper, 60, former owner of the Palmer-Leigh Small World Day Care Centerin Greensboro, North Carolina, will spend a minimum of 16 months in jail for the death of 16-month-old, Jackson Edmonds. Edmonds died of hyperthermia last March after Harper left the child in a car in the drive way of the day care center. North Carolina State officials closed the day care center the week the death occurred, declaring the day care center to be an unsafe, unhealthy and injurious environment. In North Carolina, a 2 year old boy suffered third degree burns after he lit his clothes on fire from a lighter. The boy’s parents were charged with negligent child abuse resulting in serious bodily injury. Investigating officers observed marijuana and other drug paraphernalia at the the home. The incident may have occurred after the parents had smoked marijuana.

CarAccident1.jpgAccording to Asheville, North Carolina police, a four-year-old boy was killed in a car accident while running across a busy street to catch a bus. The child was reportedly walking with his mother early in the morning, and the mother was holding the boy’s hand. The boy apparently broke away from his mother suddenly and ran into the street when he saw their bus arriving at its stop. He was struck by a car in the northbound lane. The boy suffered a traumatic head injury, and could not be resuscitated by CPR delivered by emergency personal at the scene.
