Trampoline Park and Bounce House Personal Injuries.001Over the past few years, there has been a growth in the number and presence of trampoline parks and indoor bounce house locations and facilities.  While these recreation, sports, amusement park, and theme park attractions can be great ways to have fun and exercise, they are also the locations of unfortunate and preventable injuries to children.  There are risks with any forms of physical activity and sports.  There are also safety measures and rules that should be followed to reduce these risks. If children, parents, and facility supervisors follow and enforce the rules and safety measures, many personal injuries can be prevented.
When a child is a guest or visitor to a trampoline park or bounce house, there is a duty on the part of the trampoline park / bounce house operator and owner to provide a reasonably safe play environment for the children.  The duty is one of the four elements necessary to prove up a case for personal injuries on behalf of the injured child.  The four elements are as the following:

Gymnast Personal InjuryIt is certainly an important part of childhood for most children to participate in some sports related activity.  From football to cheerleading to gymnastics to soccer and all sports in between and beyond, youth sports and related activities help make our children more active and better rounded as they mature and head out into the world beyond high school.   For some children especially those in elementary and pre-school, participation in sports related activities can and do lead to serious personal injuries.  Are there inherent risks any time that a child participates in an activity or sports related practice, game, or exhibition?  The simple answer to this question is “Yes”.  However, there are two questions that should be answered when evaluating a potential case involving a sports related activity:

There have been reports of children suffering serious injuries even dying as a result of items being left in and around the playground. Two recent incidents involved the strangulation of a child in a playground. One was strangulated by a jump rose and the other was strangulated by some type rope or twine. If the items were not left in the playground area and / or there was proper supervision in place, the incidents would have likely been prevented.

Education%20Day%20Care%20Building%20Block%20F.jpgIn North Carolina and other States, it is important that staff members at day care centers are both trained and attentive. These attributes go hand in hand. Without proper training, all of the attention in the world may prove futile in protecting a child at the day care cente. The same logic applies to a well trained individual who is inattentive or distracted from the prime task at hand – the proper supervision of the children at the day care center. At times, the wrongful death or personal injury to a child at a day care center results from a combination of a lack of adequate training / knowledge and inattention. Tragically, many injuries and deaths that take place at North Carolina Day Care Centers and other facilities could have been easily prevented.

education%20school%20day%20care%20building%20block%20y.jpgIn Louisiana and other States, children are the unfortunate victims of abuse and neglect. The victimization of a child can take place at a home, relative’s home, friend’s home, in public, and, yes, even in a day care center. When a child is enrolled in a day care center, the facility has a duty to provide the child with a safe and clean learning environment that is free from abuse. The staff should be well trained. Furthermore the staff should have the personality and patience to be able to optimally and safely work with children. Day care center workers that are unhappy with their jobs, inpatient, immature, or just lazy may end up lashing out at a young child. It is well known that children do not always listen and at times disobey adults. Furthermore, children, especially day care age children, will cry and make messes. If a day care center worker cannot handle the foreseeable and common acts associated with young children, the the day care worker should not be employed in that position. For the safety and well being of the children, a more qualified and patient day care center employee should fill the position by the day care worker who simply cannot or will not handle the serious and important responsibilities of the job.

When a child is enrolled in school or an after school program, the school has a duty to provide adequate and appropriate supervision of the children participating in school and after school activities. Sporting%20Event%20Bleachers%20Personal%20Injury.jpegIn New York and other States, there is a danger to children in most schools, parks, and sporting venues. The danger is in the form of a bleacher. Due to the height of bleachers, curiosity of children, and lack of safety awareness of children, there is a risk of injury and even death from falls related to bleachers and / or other elevated levels at schools, parks, and sporting venues. Because of these known risks, it is vital that schools, day care centers, parents, babysitters, relatives, and other child care providers closely monitor and supervise children at these events. Make sure that the children are properly seated and get assistance as needed when walking up or down stairs.
