Are All Maryland Day Care Centers Subjected to the Same Policies, Procedures, and Regulations?

Are all Maryland day care centers subjected to the same policies, procedures, and regulations? The simple answer to this question is “No.” Under Maryland law, there are different classifications of day care centers. Like many other States, a day care center is regulated depending on the type of day care center, size of day care center, religious affiliation, and / or other factors.

The three key categories of day care center facility in the State of Maryland are as follows:

Family Child Care Homes. Under Maryland law, a Family Child Care Home is operated by professional caregivers in private residences / homes. These facilities can care for up to 8 children but are limited to no more than 2 children under the age of 2 years old unless there is additional staff in place. There can be no more than 4 children under the age of 2 years of age assuming there is appropriate staff in place.

Letter of Compliance Facilities. Under Maryland law, a Letter of Compliance Facility is operated by a church or religious based organization. There was exemptions for these facilities as to the qualifications of staff and the activities / programs for the facility.

Child Care Centers. Under Maryland law, a Child Care Center can supervise a number of child but not more than the maximum as set for the State government regulations.
