What is the Liability of a Summer Camp, School or Day Care Center Regarding Falls from Stairs or Escalators?

Children, especially younger ones under the age of 5, are at serious risk for injuries when walking up or down stairs OR when on or near escalators.  When a summer camp, school, or day care center is supervising children on campus OR on a field trip, it is important to provide the necessary supervision to make sure that children are kept out of harm’s way.  Many staircases are built in a manner in which a child could crawl or squeeze between the bar. As such, at any given moment, a child, who is not under the constant watch or supervision of a child care provider, could slip away and suffer from a fall that leads to serious personal injuries or even death.
There are a number of You Tube on the Internet that show children falling from stairs OR an escalator.  It should be noted that children often see an escalator like a piece of playground equipment.  Children often lack that certain good judgment to understand that dangers of playing in and around stairs and escalators.  There are a few videos posted to You Tube showing a child climbing on to the moving railing of the escalator and heading down head first on the tummy / stomach.  You can see the child fall off of the escalator and fall 2 to 3 stories to the concrete floor down beneath.  These videos and incidents should serve as a reminder to others – especially parents and child care providers – about the importance of supervision and safety for children in or near stairs and escalators.   Here is one such You Tube video to view – Child Falls Off of Escalator at Shopping Mall
