For most guests and visitors, the days and nights are filled with fun, adventure, laughter, and good times. Unfortunate for some children and adults, the theme park, amusement park, or water park is the site of a catastrophic personal injury or death.  When a business operates or manages a recreation areas, there is a duty to keep the grounds, rides, and attractions in good repair and to have attentive ride operators, supervisors, and lifeguards in place for the safety and protection of the guests and visitors especially children.  Theme parks, amusement parks, and water parks invite and market to families and children. cal-0814-cl5-funpark11During most visits to a theme park or amusement park, the days and nights are filled with fun, laughter, time with family and friends, cotton candy, and just plain old fashioned fun.  Unfortunately, for some children or adults, a visit to a theme park or amusement park can end with a serious incident / accident causing personal injuries.  Amusement parks and theme parks advertise to and welcome adults and children alike to the rides, grounds, and attractions.  As such, it is vital that all rides and attractions are probably assembled, up to date on inspections, and operated by trained and conscientious ride attendants.  If a ride is not properly secured or latched, some terrible personal injuries can result.   Furthermore, if one bolt or piece of tract is out of place or out of repair – then other similar mishaps can take place leading to serious personal injuries.  Like other cases involving personal injuries, there are four essential elements to pursue a case or claim for personal injuries taking place at a theme park or amusement park as follows:

One potential dangerous condition in or near bounce house area is concrete.  If a bounce house is placed on concrete and there are any exposed areas, a serious personal injury can result.   There is also a danger to having any entry or exit areas near concrete.   As a child is entering or exiting a bounce house, the child can easily fall or lose balance.  This, in turn, can lead to a hard impact on the concrete.  This is especially dangerous if the child’s head hits the concrete ground surface.  Because of the dangers associated with bounce houses, it is advisable that bounce houses be installed by trained professionals and that all reasonable and available safety measures are provided to prevent serious injuries to children playing in or near the bounce house area.

sports_1000009537-120613intIn the summer and other times of the year, there is always a risk of drowning to toddlers, children, teenagers, and yes adults.  Putting safety measures in place is not just for special events and public pools.  Safety should be a priority any time that a person (of any age) is on, in, or near the water whether it is a swimming pool, water park, wading pool, lake, river, canal, or ocean.   Even a lazy river winding itself around the confines of a luxury resort can be the site of a horrible yet preventable drowning or near drowning incident. Most drowning or near drowning incidents can be prevented with the proper planning and the proper supervision of the swim area.   Let’s talk a bit about supervision.  Here is an equation to consider:

103-1113tm-vector2-2933During the summer and other times of the year, children are welcomed visitors at trampoline parks, bounce house activity centers, attractions, and theme parks.  In fact, at these locations, the marketing efforts of the companies and corporations are commonly directed to children.  As such, if children are a major focus group of a company or business, then safety of those same children should be a priority as well.  Of course, with any physical activity, there is a risk of injury.

Children, especially younger ones under the age of 5, are at serious risk for injuries when walking up or down stairs OR when on or near escalators.  When a summer camp, school, or day care center is supervising children on campus OR on a field trip, it is important to provide the necessary supervision to make sure that children are kept out of harm’s way.  Many staircases are built in a manner in which a child could crawl or squeeze between the bar. As such, at any given moment, a child, who is not under the constant watch or supervision of a child care provider, could slip away and suffer from a fall that leads to serious personal injuries or even death.

 Trampolines are common sites in most neighborhoods especially those with small children.  While a trampoline can provide children with an activity that is away from the computer, smart phone, X-Box, and other sedentary activities, the trampoline can also be the site or location for serious personal injuries.  Unfortunately, many homeowners,  business owners, school administrators, or amusement – theme park operators  with trampolines on the premises fail to maintain the trampoline in a safe condition OR fail to provide adequate and appropriate adult supervision during the child’s use of a trampoline.   Small children especially those with poor motor skills are especially at risk for trampoline related personal injuries.   There are some safety precautions that can and should be taken as follows:

They were set up and supervised by professionals who had experience with the bounce houses and inflatables. Over time, bounce houses and inflatables became affordable and accessible for just about every parent or person throwing a back yard party. It is common for a parent to rent an inflatable and get limited to no instructions as to safety while the bounce house is in use. There are some companies that take the time to provide safety precautions and recommended rules for use. There are also some companies that provide supervision in addition to the delivery of the bounce house. Supervision is well and good as long as it is consisent and free from distractions. Having a bounce house attendant in place but on his or her mobile phone most of the time is not much better than no supervision at all. When a parent or person rents or puts up a bounce house for use by children, it is important to keep some safety rules, tips, and precautions in mind and in place.

Medical%20Care%20-%20Emergency.jpgIn South Glens Falls, New York, a horrific event unravelled right before the eyes of children, adults, and bystanders. During a 25 MPH wind gust, a bounce house lifted off the ground with three children inside. The bounce house was lifed 50 feet into the air. Serious personal injuries resulted from this incident. The children were taken to Albany Medical Center for treatment. It was reported that the bounce house was distributed as a Little Tikes bounce house.
